• Does absconding from PSU creates problem for my future employment?

1) i have joined a PSU 2 months back and I'm still under training. Now I'm frustrated with the work culture and dont want to work with this organisation.
I have signed a bond for a period of 5years
Additional insights- there were also cases in which court has stated to pay the training cost while leaving from the organization.
2)now I would like to abscond from the job and i have the confidence that I can get better employment?
3)please guide me about this and tell me the consequences of leaving organization without intimation?

If you have signed a bond with them, absconding can have some repercussions on you.

They may initiate legal proceedings against you on strength of the service bond you signed with them.

Since they have actually invested on you, by way of providing you training etc, defending the case which the PSU files against you would not be easy.

Nothing to pay nor to worry.Left thinking about this employment, only thing to do is not to give in writing nor receive any letter from the organization tell your family members also that to avoid the same by saying that (प्राप्त कर्ता यहाँ पर नहीं रहता ).Stop going right now and if in the office left without saying anything from anybody else.

Leaving without giving due notice will put you in breach of contract.

You will absolutely burn your bridges with this company and most likely be recorded as not re-hireable and is also going to pose a lot of issues in in future employment.

You could be treated as an absconding employee and theythey initiate recovery proceedings against you.

In that case you should give letter to the concerned person in your PSU stating that you are ready to pay the amount spent on training you, but not the bond amount since it is violative of section 27 of the Indian contract Act which states that any agreement in restraint of trade or profession is void and cannot be enforced.

it is advisable that you do not leave the company without proper permission and serving the full notice period. If you leave without proper resignation, the company might file a case against you and ask you to pay compensation. Since your employment is governed by your employment contract, you will have to serve the notice period specified. If you do not fulfil the terms and conditions of the agreement the company can take legal action against you.

If you are absconding the job the a authorities may initiate legal action not only for recovery of bond amount but also may initiate disciplinary proceedings agaisnt you and may terminate you from the services which may affect your future career when ther is a background verification.

Hence before taking any hasty decision on this better consult a service law practicing lawyer in the local and get his advise to deal with the situation prudently.

The supreme court judgment also states that you will be liable to pay the amount proportionately and not eh entire amount, hence you may talk to the authorities about it and initiate process accordingly
