• Issue with Bank of India - Non Co-operation

Me and my wife had opened a joint savings account with Bank of India on 30th January at Kolkata (my hometown). At the time of opening the account, I asked the Bank manager whether netbanking services are available or not. He said yes it is available and if you face any problems, we will help you out once you send an email.

I opened the account and transferred around 5 lakh rupees to my account. It has been two months and I still have not received the transaction password which is needed to open fixed deposits through my net banking account. I have called the customer care many times, they say - contact home branch. When I contact home branch, nobody picks the phone. Somehow I got the personal number of bank staff, they tell me - we cannot do anything, please contact your nearby post office. When I go to post office, no letter is received in my name.

At the end of the day, I have not received the transaction password. I have emailed the bank multiple times and they keep saying the same thing - there is nothing we can do. I have told them to re-send the transaction password to my office address in Chennai but it has been one month and I still have not received it.

I have officially complained through the bank's website but it is broken and the complaint does not go through. I have written a formal complaint to the zonal officer, to bank of India headquarters and also to Reserve bank of India banking ombudsman but I have not received any response from any of them. I have the email response copies from bank of India staff which I can share on request

I am losing money on interest fees and have to go through all of this harassment and lack of co-operation.

1) You must move the consumer Court. Make not just bank of India, but RBI also respondents.

As a final measure, send them a legal notice in the present matter calling upon them to ease your inconvenience by way of ensuring that you are forthwith issued the transaction password. In case they fail to respond to the legal notice and do no comply with the same, file a consumer complaint against Bank of India in the District Consumer Forum.

Collect all correspondence copies both email and physical. Take print out of all email  complaints and replies made by bank. 

This is a clear case of deficiency in service. File a complaint  in district consumer forum stating all facts with claim for compensation.

1. This is a deficiency in service on the part of the bank.

2. You are free to file a complaint case under Section 12 of Consumer Protection Act to seek a direction to bank to send the transaction password to you and also compensation for the loss and mental agony.

Since none of  your efforts fetch any fruitful result, you may resort to legal steps.

First issue a legal notice to the bank manager where you have opened the account and the request for the internet banking facility was given.

Let them give a reply denying your allegations after which you can drag them to consumer forum seeking relief and compensation for the deficiency in service.

In the meantime you can withdraw the amount you have reportedly parked in the FD
