If that road is public property, (government property) then nobody is permitted to construct anything there. 

If your neighbor commences any construction, it amounts to encroachment upon public property. You must complaint to the municipal authorities and the police. Your neighbor will be prosecuted and punished

You just check whether they have sought any permission from the concerned authority of the government if not then complain about the same to concerned authority or check the information under R.T.I. and take action by filing PIL
