You can purchase property of religious society if society pass such resolution that the society is selling the property for welfare and put the money in further development of society and community.

Also the person signing has to be authorised and permission from registrar of society has to be obtained.

Yes, the property belongs to the trust as per the trust act. Kindly check under which law society is registered.

1. The religious society property is permitted to be Sold /Purchased ONLY with the written consent of the Charity Commissioner, under whom the Society /Trust would have been registered.

2. Proper Resolution of the Society /Trust, Articles of the Society /Trust, Demarcation or layout plans of the property, consideration amounts, transfer of such property etc.... must be duly verified before purchase.

if society is registered, yes you can buy the property but be careful during the transaction and take services of one experienced lawyer as the deal requires extra documentation, permission, authorisation to be checked.

A property registered to a religious society must be registered under the societies registration act and hence that property belongs to the trust and cannot be purchased by you.

Dear Sir,

You can purchase provided you get a copy of resolutions of such religious institutions which makes it to sell the property.  Show such resolutions to expert legal adviser and get opinion.

What is the religious society bye laws say about selling the trust property.

You may have to read the resolution taken to sell this property by the trust members, if the decision was taken to sell the proeprty based on the circumstances, you may take a legal opinion from a local lawyer and proceed if recommended.

  1. As per the information mentioned in the present query, makes it clear that you want to go ahead and wish to buy a property which has been registered for religious puspose.
  2. Let me tell you that when these properties are been purchased, the same come at little lower rate in comparison to other purpose.
  3. So, if you wish to buy the same then may have to seek permission to change the usage of the same, and for that you will be asked to pay some transfer or nature/ use of the property from the SDM of the area wherein property has been situated.
