• Working Lift License Problem.

My apartment got completion two year ago, but my apartment lift contractor/maintenance person have not given license, as well as not shown us any government document.Because, of some dispute between a builder and contractor we are suffering.Finally we switch off the lift.
is there any solution for this?
can i change the lift contractor?

1. LIFT license is issued by the "chief electrical inspector" of the district Lift Dept. A duplicate license can be obtained via proper application and payment of fees.

2. Serve a proper Legal Notice to the Lift Vendor and the Builder, for the faulty /illegal lifts, and just simply terminate the Lift Vendor's services and clearing off his dues. A new licensed Lift AMC vendor may be duly appointed with proper agreement.

1. It is not clear which was entrusted with the job of installation, running and maintenance of the lift and whether you have paid money to this body or not.

2. If yes, then it is a fit case when you can file a case before the consumer forum wherein you would get refund of your along with damages and compensation .

3. in such case you will have to apply for license on your own or through another professional body.

If the association is formed then by it or all the members can file a consumer complaint against the builder and the contractor.

Yes all members can change the lift contractor.

A license from the electric inspector is required.

If earlier license is lost then you can get the duplicate license.

You need a licence to operate the same. You need to send a legal notice to the contractor and builder and contractor to resolve the issue otherwise you can change the vendor

The lift and other amenities us the responsibility of the builder and he alone is responsible for handing a completed apartment to the residents. File a complaint against the builder in the rera tribunal and also in the state consumer redressal forum.

Send a legal notice to your builder/promoter in the present matter and seek immediate intervention from him, ensuring that the lift is put to working condition immediately.

Approach consumer forum/RERA in the case builder/promoter fails to do the needful despite the legal notice.

Which license is required for operating passenger lift in a building?

Under the provisions of Bombay Lift Act-1939 and Delhi Lift Rules-1942, any passenger lift installed in any building except the buildings maintained by Public Works Department and MES, can be operated only after obtaining a valid license.

Why is lift license important?

The license ensures that the lift complies with safety measures laid down in the above mentioned Act/Rules and Bureau of Indian Standards. It is issued only after confirming the safety of electrical installation of lift, its layout, safety mechanisms and safety gears, etc.

Who is responsible for granting this license?

Inspector of Lifts of the respective state is the concerned authority for grant of license for lifts in buildings.

What is the procedure to obtain permission for erection of the lift?

After the building’s completion, if the owner wants to install a lift he should submit an application on a prescribed form ‘A’ to the Inspector of Lift. On receiving the application, the site is carefully scrutinized by the Inspector. If he considers that the site meets the requirements listed under Lift Act & Rules, he issues the permission to erect the lift.

How to obtain a license for working of the lift?

Once installation of the lift is complete, the owner/occupier of the building has to submit Form-Balong with the prescribed inspection fee to Inspector of Lifts. After receiving request on Form-B, the inspector of Lifts inspects the lift and its installation. If he is satisfied that they comply with the provisions/specification prescribed in the Act/Rules and relevant Indian Standard Code, he issues the license for working of the lift in Form ‘C’.

What is the fee to apply for this license?

The fee charged for the inspection is as follows: -

  1. a)     Lift having a speed up to 1 mtr. Per sec. = Rs.520/-(each lift)
  2. b)     Lift having a speed up to 1.5 mtr. Per sec. = Rs. 770/-( each lift)
  3. c)      Lift having a speed more than 1.5 mtr. Per sec. = Rs. 1020/-(each lift)

Which documents are required for lift license?

  1. Application on a prescribed form ‘A’
  2. The drawings of the Lift installation
  3. Attested copies of experience certificates
  4. Attested copies of Previous Certificates of Competency Class II issued by the board
  5. Original Treasury receipt
  6. The application must be signed in the presence of the Employer/ Magistrate/ Gazetted Officer/ Member of Parliament/ Member of Legislative Assembly or Municipal councilor.
  7. One recent passport size photograph duly attested may be affixed in the form & another should be properly attached along with application.
  8. Two self-addressed stamped envelopes of size 9″ x4″

What is the validity of the Lift License?

The lift license is valid for one year. The application for renewal has to be made three months before the expiry date.

Yes you can change the operator 

Clearance from the labor department is required for the operation of the lift 

Send him a notice and ask him to complete the work failing which you may go ahead and change the contractor

- You can approach the consumer forum against services issues under given commitment from the Seller to purchaser or by consumer.

- Besides, the RERA tribunal can be approached against builder inefficiency on providing the committed services.

- It is Builder responsibility under BBA (Builder Buyer Agreement) and SLA, to provide all the committed services.

Lift Licence. Electrical Lift Installations in commercial, residential, office complexes, etc., (excluding the lift covered under the Factories Act, 1948) are inspected and licenses are issued / renewed to secure protection to the persons using the lifts and safe working of lifts.

The promoter or the builder is responsible for providing and maintaining essential services on reasonable maintenance charges to be paid by the residents.


You should approach the builder to set right the things with the lift operator since the builder is responsible for this lift contract.

 

If there is no response from the builder then your association may in a meeting decide about the next course of action in this regard.
