• Registration of new car

I am an Army Veteran, bought a Hyundai Creta in my name, but for my only child, a serving Capt in the Army. Car was delivered on 15 Feb 19 by M/s Hana Motor Plaza Pvt Ltd, A-30, Mohan Cooperative Industrial Estate, Mathura Road, New Delhi – 110044. The Hyundai dealer has shut-down and it's overheard that they claim bankruptcy. Like many other customers, I too lodged my FIR with PS Sarita Vihar, New Delhi, vide Complaint No [deleted] dt 13 Mar 19. Thereafter I lodged my complaint with Govt of India through INGRAM, Grievance No 1206350 dt 14 Mar 19. And lastly I lodged my complaint on 14 Mar 19 with M/s Hyundai Motor India Ltd with SR Ack [deleted]. I have received a confirmatory call from HMIL. However, I await calls and resolution of my problem. The Temporary Regn had expired on 15 Mar 19. I have requested HMIL to arrange extension of the Temporary Regn and also arrange Permanent Regn of my car, for which the required amount to be paid to Govt of India, was paid by me before taking delivery of the new car. Please advise me if my steps are in order and what should I do to get extension of Temp Regn and Permanent Regn at the earliest.

See you can follow up.with HMIL for permanent registration of car and you have also paid the road tax and registration amount since they are much concerned about there image you can ask send legal notice and also can use social platform so that work is done fastly.

The steps taken by you are proper though in case they fail to register you register by your self by approaching.concerned RTO and recover the cost from HMIL .

1) issue legal notice to Hyundai abd it’s dealer to obtain permanent registration of car purchased by you 

 

2) if no action is taken file complaint before consumer forum against dealer and manufacturer seek orders to direct them to obtain permanent registration of your vehicle 

 

3) seek litigation costs and compensation for mental torture undergone by you

Dear Sir,

 

- It is solemnly HMIL responsibility as dealer was its representative and any lackness in services or deliverable committed by dealer shall make both responsible.   

- Consumer court can be approached for your grievances.

- You can make party to both HMIL and Dealer, along with all payment receipt and all available evidence you can produce to make your case strong.

- Generally in Consumer Court you need not require any lawyer however to save your time, you may hire the one.

A policy of the company getting the registration done should be in place. In any case you should file a complaint against the company after sending a legal notice in the district consumer protection forum.

Serve Hyundai India a legal notice and advise them to remove your grievance,

if they do not take any action, immediately make a complaint in the Consumer Forum and make claim for registration of permanent number, mental harassment, agony, compensation for not using your own vehicle instead using commercial services, litigation cost etc.

Dear Sir,

Documents to be Submitted for New Car Registration

Ensure that you collect the documents from the car dealer at best before taking the car delivery, it will save you time and further follow ups :-

- Invoice: You need to Procure and Submit both Retail Invoice and Manufacturer Invoice of Car (which is mandatory for self registration at time of delivery of car)

Sale Certificate (RTO Form 21): As per RTO, a sale certificate is mandatory to be submitted, RTO Form 21 needs to be submitted by dealer. In case, dealer do not do so you can also get it downloaded from our RTO Form Section of Mycarhelpline

- Pollution Certificate (RTO Form 22): Form 22 depicts Pollution Certificate and is required to be obtained and to be submitted to RTO confirming that the vehicle sold is in compliance with Safety, Road Worthiness and Pollution Certificate

- Copy of Insurance Cover Note : A copy of Insurance cover note (if issued by dealer or issued by agent) also needs to be submitted in RTO

- Adding Loan HP (RTO Form 34) : Form 34 (optional for adding loan hypothecation, if vehicle was financed) to be additionally filled and submitted. Form 34 requires stamp and sign of Banker. A Dealer can assist you in same, wherein registration would be done by you

- RTO Form 20 for Car Registration need to be submitted 

- Chasis Imprint: Have a copy of Chassis Imprint done of the car (through pencil)

- ID & Address Proof: Self Attested Valid ID along with PAN Card and Address Proof. A Valid ID Proof Document should be one as per prescribed list of RTO (Copy of Election Card, Passport, Aadhaar UID Card are best documents as they contain both ID and address else)

- Temporary Registration : Temporary registration is valid for 30 days. So if you buying a car on Temporary registration, and intend to register car on own - then copy of Temporary registration is also required to be submitted in RTO.

 

Additional Documents in case of Car Bought in one State and registered in Other State

» Sales Tax Clearance Certificate (of the VAT Paid)

» NOC from Selling Dealer and RTO Office that Sale is Genuine and never ever been registered - Its more a confirmation which is been asked by RTO and not required in all RTO Offices. So may check

The car registration is the problem you face now?

Since the problem is beyond your control and also since you have written to many authorities in this connection, you may try to get an extension of the temporary registration on the basis of the said information you have furnished here.

You may even try to get the permanent registration without the help of the dealer based on  the practical issues that are going on.
