• Payment of penalty under Customs Act

I had made an online purchase of an item prohibited under Section 112 of Customs Act. I had received a Show Cause notice for the same around 5 months ago, to which I had replied saying that I authorize the confiscation of said item, and would be willing to pay penalty for the same, when instructed to do so.

This week, I received another notice from the Customs department, saying that I had not responded to the Show Cause notice. It also said that a personal hearing was granted to me, which I did not attend (I received no notice about a hearing). Finally, it notified that the item I had purchased has been confiscated, and that a penalty of Rs. 5000 has been imposed.

However, there is no information as to how it is to be paid. What is the procedure for paying the penalty? Can it be done online?

the penalty or charges are to be paid to the postman who will bring it is the normal procedure that takes place but in ur case if its confiscated and you are called up to see the customs office you need to carry all documents such as purchases details and stuff or mail it to them they will send it to you by the post man who drops letters generally and you pay to him.

Hi,

It is suggested to approach the office from where the notice is received.

If you would like to close this chapter by paying the fine, you may approach the authorities in the address given in the notice sent to you and enquire about the procedures to pay the penalty amount or you can write to them asking about the procedure to pay the same.

You can even engage the services of an advocate who will advise you properly on further proceedings on this.

  1. As per the information mentioned in the present query, makes it clear that your item has not been consficated and you can’t even get it back untrue you want it, I believe so.
  2. But, yes, you will have to pay the penalty for sure sir as this is the penal provision, if you don’t pay it on time then it may be possible that they might get the warrant to be issued to you.
  3. So, you can search for the online payment, if not found then you should go to airport authority for depositing the same before the custom officer.
