• Biappa approved layout

I am planning to buy a Biappa approved layout in north Bangalore. It is RERA registered also. But when I saw the khata it is mentioned as ‘Akarama vallada’ which means the layout is not approved. I am little confused on how an Biappa approved layout can be an unapproved layout. This is e-khata.

Can I go ahead with purchasing this land

No, kindly visit Bangalore Municipal Corporation, area engineer officer who pass the layout. Where you want to purchase flat go in particular that zone office and check with layout sanction engineer all details regarding project.

Sir if the plans are not approved you should not purchase same further contact the BIAPPA authority to seek clarification on same there might be issue in updating ekhata also.

Dear Sir,

The approving body depends on the area, like which it comes under, be it BDA, BBMP, BMRDA, BIAPPA or DTCP. In your case go to BIAPPA office and check with the approval number and crosscheck with the servey number shown in the approved layout plan.

Registered with RERA has nothing to do with govt.approval.

Ask the builder to provide copy of approval order than only proceed further. Don't rely on oral commitment.

You should find it out and then only invest 

  • You can file an RTI and complain it to the RERA in writing. 
  • RERA can take cognizance and give you a satisfactory Reply.

 

What company tend to do is they start the project and later on they keep on taking clearance and other certificates 

As if any fault is find on their part then they are inlo liable for everything and penalities.

E-khata is not valid, it is issued for the purpose of tax receipts and it will not confer the rights on the buyer or the owner with the title.

Registration with RERA and BIAPPA approval is not proper since the approval by the competent authority is essential.

You may refer the papers before an experienced advocate in the local and take his legal opinion before proceeding with the purchase
