• Easement dispute

A guy has put a case on me for to leave road to him
And the case is running in court so my question is i have provided all the documents copy (COPY'S) to court, but not orignal. do i have to provide or submit my land orIgnal documents as my loyer is asking to submit it to court and also if submited do i have to get a recipt of me submiting the orignal document from the court . What will be that recipt please explain thank you

1) Court registrar will notify that original papers has been submit in the court. You just has to submit land records which you get every year from local grampanchayat office.

 

2) And for easement case on has to show local layout plan from main road to your house and the other party house.

See you need to present all the documents in original before court for deciding the case , you need to file the documents along with the list and get same exhibited before court . As there is no such receipts of same.you can get endorsement of same on your OC.

Dear Sir,

Certified copies will also serve the purpose. Better try to solve the problem by producing certified copies. If  originals are producing then ask your lawyer to file a memo before the court to keep the originals in safe custody. The Shestedar/Manager will keep the same in safe custody and same will be noted in the order sheet with respective number. Certificd copy of such order sheet would be your acknowledgment.

You can submit certified true copies to the court, if not available then the Originals must be submitted. In which case, your lawyer will prepare a Memo/Index of documents that would be submitted to court on your behalf, once this is done, the court will note it down in the order sheet on the day of submission, this will be your receipt. Alternatively you can ask your advocate to submit these originals at the filing counter and take an acknowledgement on his office copy.

  1. As per the information mentioned in thebpresnet query, makes it clear that you are concerned about the receipt of roginal documents, if given submitted in court of law.
  2. Yes, it is right that we have to supply the original documents in the court, but there is ko way of getting any receipt of the same.
  3. But, it doesn’t mean that you won’t be having any proof of your original documents being submitted in the court.
  4. You must apply for the certified copy from the court records after paying a nominal fees, and those documents would have seal of the court which would show that the originals are there in the court of law.

1.  Any document submitted in court should be via a "list of documents" and the same will be taken on court record via the courts roznama.

 

2.  There is no system of Court Receipt of submitted documents.  However you can make an application for certified copies of your documents that you submitted in court.

You can first file the original documents before the court, get it marked, after that obtain a certified copy of the same, file it again before court and seek return of  your original document by replacing the certified copy of the same, this will solve your purpose also.
