• Sales agreement created fake

Dear Sir,

I have site in Rural bangalore and some of the local brokers created the Fake Sales Agreement without our signatures but now they asking to register the site to their names and also doing Phone calls and Speaking like Rowdys.
Please suggest us.

Dear client.. Give police complaint..and file criminal case against those ppl who is threatening u over phone call..

File a police complaint for fraud , cheating with the local police station.

Further in case they go for specific performance of.the agreement in court the validity of such agreement can be challenged.

1. If you are so sure that you haven't signed the sale agreement and what the brokers are showing is a fake document, then complain against them to the jurisdictional Police Station.

2.  If the matter is not resolved even after the interference of the Police, file a private complaint in the competent court.

these agreements are not binding at all but it is a matter of evidence to prove that the agreement is fake and has been entered into after misrepresentation and fraud. You can file legal complaint in police station u/s [deleted] against brokers.

  1. As per the information mentioned in the present query, makes it clear that they have been harassing you for no reason and any interest at your side.
  2. I advice you to file a written complaint to the local police station about the same and do not vacate the possession go the property at any cost.
  3. If police doesn’t do anything then send the same compliant to DCP and then file a complaint under section. 156(3) of he Cr. P. C.
  4. Once you do that then I am  sure police will look for those people and punish them also, please have faith in our judiciary.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, fraud against the person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet.

You can give a complaint to the local police about it, no doubt they will be in nexus with the local police also, however you lodge a complaint and keep a copy of the complaint for taking up the matter with the higher police officer if the local police is not cooperating.

Dear Sir,

You need to publish an advertisement in a local newspaper proclaiming your ownership over the property and warning others not to enter into any transaction with respect to the said property. You also need to file a civil suit in the court having jurisdiction over the area where the property is located for "declaration of title and restoration of possession". Meaning, a declaration by the civil court that you are the lawful owner of the property and for possession of the property to be handed over to you.

The buyer, if has purchased it bonafide has his remedy against the fraudulent seller. You cannot be deprived of your property only because some one has purchased the same in good faith from a fraudster.
