• Indian national marrying Pakistani national, visa questions

I am Indian (Hindu) and planning to marry a girl from Pakistan (Muslim). We are deciding to go to Latvia (a small European country) on a tourist visa and planning to get married there. Once we get married, we want to come to India. Following are my questions (Hardly needs 1 line answer)

0. Will that marriage certificate be applicable in India? (May sound stupid but I wanna know)
1. Will Indian govt allow us to come back to India? 
2. If yes, where does she need to apply for visa, can it be done online on priority basis, because she doesn't want to apply for visa from Islamabad or any part of Pakistan. 
3. What kind of visa she needs to come back here in India as my wife?
4. What will be the processing time for the visa, because we can only stay in Latvia for 30 days. 
5. How long can she stay with that visa in India?
6. Whatever visa is issued to her here in India, can she visit other countries too in that time? For instance: She gets 1 year visa so in that duration can she go to some other country also like UK?
7. Can we ask for asylum in any country, if yes can you tell me which country is better for this kind of situation?

Dear Sir,

As per your information you want to marry at Latvia, so before how can you legally claim her to be your wife and get passport and visa for a foreign national from India without establishing relation.

Your questions can well be answered if you approach the Embassy or passport office of your area.Please carry both of your documents, so that if any possibitly arises can be worked upon.

1) you can register marriage with Indian embassy under provisions of foreign marriage act 

 

2) marriage would be valid in India 

 

3) she can apply for tourist visa to come  to India 

 

4)  Foreign nationals of Pakistani origin married to Indian nationals and their children may be granted 'X-2' visa for a period of 5 years at a time with multiple entry facility..

The marriage can be performed in Latvia under the special marriage act in the Indian consulate or a civil marriage in Latvia as per their laws. 

First of all she needs to apply for a Visa from Pakistan. She will get a tourist  visa for Latvia. She cannot come to India on that Visa. Therefore even if you do get married in Latvia you cannot come to India and stay here as she has to verified that she is not a soy etc. As you already know about the relationship between our countries. She cannot go back to Pakistan as she is marrying a hindu and her parents would not allow this. For asylum you could go to Latin America or Africa.

Your marriage will be recognised in all other Europe countries.
If you get married in a Europe country that is not your country of origin it is recommended to register the marriage at your home country's consulate Embassy.after marriage your wife can come to India on tourist visa. You can apply for protection (asylum) if you are persecuted or if you fear persecution or inhumane treatment in your home country or for other reason.

1. Yes they can marry. Yes it will.be applicable with consent.

1. Marriage certificate shall be valid in India , you can get it further registered under Foreigner marriage act in embassy in country you are marrying,

 

2. See need to apply visa on ground of spouse of Indian husband,

0.  No that certificate will not be recognised  as valid in India to recognise your marriage legally in India.

1.  You may have to follow the procedures  meant for it, i,.e., first get your marriage registered in India as per the prevailing law and then apply for tourist visa and then permanent visa.

 

2.A visitor visa is issued to a Pakistani national to meet relatives or friends or for any other legitimate purpose valid for a maximum of five specified places and for a period not exceeding 6 months with the stipulation that continuous stay during each visit shall not exceed three months. Holders of visitor/ student/ conference/business visas [other than those specifically granted
Exempt from Police Reporting (EPR) Visas] shall be required to register themselves with the
FRRO/ FRO concerned within 24 hours of their reaching the specified place of stay and obtain a
Residential Permit. They shall also make a report 24 hours prior to their intended departure from
the place of stay. 

3. If you plan on marrying in India, you'd enter with a tourist visa then, once married, convert it to an X or Entry visa. If you marry prior to entering India, you'd apply directly for the X visa.

As a Pakistan national you would not be eligible for a PIO card, which would permit employment and have duration of 15 years.
