• Merging of two HUFs

I (Kartha) & my wife have one HUF and my Son & his Wife have another HUF. 1. Can we merge both HUF? if yes , then can we transfer the property in one HUF ? 2 if merging of two HUFs is not possible. then can my Son dissolve this HUF leagly and then become the member of my HUF? Please Suggest me leagly.

They can dissolve the Huf and further can merege.the property in your Huf after that they can be member of.your Huf.

It can't be merged but can be determined partitioned with approval of AO. The second option of joining the other HUF is possible but dissolving one

Dear Client,

No law regarding merger of HUF. dissolve any one HUF and than member gift their share to existence HUF and Karta of that HUF will include members in his HUS.

It may very well be possible for them unite later on by bringing the properties together again by merging the HUFs so that the conditions of the Hindu Law is not violated as regards the coparceners and the members who can form the HUF. Such a merger is also known as Reunion in the terminology of Hindu Law.

Under Hindu law, there can be a HUF within a HUF. Therefore, a son can have his own smaller HUF while he continues to be a member of his father’s  HUF.  In his father’s HUF, he is a mere member – coparcener and in his own HUF, he is  Karta.
