• Surname is misspelled in Absolute sale deed

Hi All, 

I registered a flat in my name and after executing the sale deed I am seeing two alphabet is interchanged in my surname. It should be "...yo..." but spelled as "...oy...". Rest everything is fine. I am not sure what should be done here. Is an affidavit or notary helps? I am not sure if rectification deed is only option. Is there any other way to get it resolved? Any help is deeply appreciate.

See registered rectification deed is best option here make a rectification deen stating the change and register same.

Affidavit also helps but better to get the deed registered.

1.Spelling Mistake in your name( in the nature of a single letter missing ) will not affect your title to the property unless there have been any major mistakes in your name, fathers name or the details of the property. 

2.You can register a rectification deed by correcting and rectifying the mistake.

3.you can so make a declaration by notary public that oy and yo are the same persons.

Deed of rectification has to be executed to rectify the spelling mistake in your name

1. The mistake is very minor which can very well be ignored.

2. However if you wish this can be rectified by way of making a registered deed of declaration/rectification in which signature of both the parties is required.

3. The cost for execution of such deed is very negligible and stamp duty need not be paid again.

In such cases rectification deed is only solution and opting for any other method is not proper. Get rectification deed from the concerned vendor.

It can be corrected - but another deed of correction will be prepared and annexed to the original sale deed.  Contact your sub-registrar for the procedure.  He will advice.  When you know there is a mistake... there is no point in keeping it quiet to the advantage of someone who might litigate in future.  But otherwise its not a serious error to fear much about.

if there is some mistake in the deed then a deed of rectification will have to be filed in order to get the same corrected in the records.

1. File unilateral Declaration Deed, supported by relevant documents pertaining to correct name. Annex the original sale deed with the declaration deed.
