Wife runs away to maternal family and threatens to commit suicide. 

My wife keeps on threatening me for committing suicide. Reason is petty; She does not want to take responsibilities of family tasks. All she wants is to gossip with neighbors and take rest. My income is limited and she belongs to an affluent family. 

Mine was a arranged marriage

We have two kids and are married since 2008. Now, my parents are old and I want to keep them with me but she is against this and keeps on playing tantrums so that I cannot bring my parents to stay with me. My father is 70 yrs and mother is 65 yrs old. She has has undergone angioplasty and is suffering from type 2 diabetes.

This time I brought my parents to stay with me against her wishes as they are living alone in my hometown on their own. Since, then she is blaming them of abusing her, conspiring against her. When I tried to mediate to understand what the problem is, she want them out of the house. So, I had to stood by my parents. She tried to threaten me to commit suicide and frame me and my parents for this. I then spoke to her parents but they took her side and later said will talk to her. 

Then on 22.01.2019, surprisingly her brother shown up at my door to take her back to her home. I asked her why is she doing it, then her brother said he is taking her for 10 days to home so that she will feel relaxed and return back. But I was shocked to see that she left her kids behind to stay with me. Later, I realized that she has taken away all the jewellery, her clothes and the Fixed Deposits, NSCs and the LICs held by me and jointly by us.

Last week I received a call from my in-laws about my decision to choose between my wife and my parents, so I chose both to which they asked me to wait for legal actions and threatened me to charge for domestic violence. Please help me as my wife is mentally stable and want to falsely accuse me for domestic violence and dowry demands. 

I approached local police station for help but they shoo me away and made fun of me by saying no one can help you. Said will always take side of my wife whether she is right or wrong.

Send message to wife that she had gone to her parents place along with her jewellery , clothes and other articles . Request her to return to her matrimonial home 

 

2) also file NC with police station that wife has left her matrimonial home with her jewellery, personal articles 

 

3) if wife refuses to return to her matrimonial home you can divorce your wife as per Muslim personal law 

 

4) divorce should be preceded by attempts at reconciliation 

 

5) reasons should be mentioned for divorce and pay her Meher amount and maintenance during iddath period

You should in your message mention that she has left her matrimonial home on her own accord and has taken her jewellery and other personal articles . Request her to return to her matrimonial home 

 

2) send letter to police by registered post if they refuse to take on record your NC complaint 

 

3) in event wife files false dowry harassment case apply for and obtain Anticipatory bail from sessions court

1. Since she has taken her jewellery, clothes and the Fixed Deposits, NSCs and the LICs held by you and her jointly you should immediately issue a lawyer's notice to her to assert that she has taken her stridhan. This will help you when you apply for anticipatory bail if she files 498A.

2. Police cannot bring her back.

3. If and when she files cases you will have to contest those on merits.

Sir if police is not helping give a written complaint to the SP stating all the facts that wife is intimidating for false cases and suicide. Further separating you from the old parents and daily along with her family she is intimidating of false case. If Sp takes no steps then file a private complaint before the jurisdictional magistrate regarding same.

1. Send a restitution notice from lawyer asking her to rejoin the marital life and further asking stating that her demand of separating you from parents is illogical and unreasonable.

Dear Sir,

Attempt to suicide is also an offense if she commits such offense in future then simple hand over her to the police and ask them to book a case. Even now on her threats of black  mailings and your recordings police can book a case. Just threaten her through police.

ask for an arbitration meeting, arranged by elders of the couple so that a reconciliation may be reached. If such efforts fail and the man sincerely thinks he cannot live a harmonious life with his wife, he may divorce her either verbally or in writing. In both cases, it is recommended for there to be two witnesses present on the occasion of the pronouncement of such a divorce..

File court complain if police refused to registered or sent complain via registered mail, than police cant fail to register it.

Police will be of no help to you until you lodge a criminal complaint against her.

If the situation is intolerable then you may file a contested divorce cae or can file a RCR petition and await her reactions.

If she resorts to file false criminal case and DV case, you may have to face them properly in the trial proceedings on merits and documentary evidences supporting your defence.

1.  You dont accept their demand for sending your parents away from your house, you can send a legal notice asking her to return to the matrimonial fold if she does not comes back then you may file a RCR case.

 

2. That was a mistake you did, since you know that she has taken away her jewels, you may mention the same in the legal notice as well as in the RCR petition to create a record in that aspect.

3. If you apprehend that she may commit suicide you may file a complaint with the local police seeking protection from her suicidal threats.

This will protect you as a shield even if she commits suicide.
