• Buying a land

As per the rocord of 1954-55 record the land belonged to a general category person. But in the record of 1994-95 the land is registered to a ST category person. Currently the land is registered to a general category person. Can I buy the land? Location is Bastar district of Chhattisgarh state.

You can purchase the land if it was not granted by state to persons belonging to scheduled caste / tribe 

 

2) if you purchase land belonging to scheduled caste or tribe without obtaining permission from collector then govt can evict you from such land deliver it to original grantee or his legal heir

Dear Client,

This may be cause of land issued to General category person than general owner sold the property to ST purchaser which again may resold to general purchaser. Check chain of documents.

the land allotted to  the SC/ST community at free of cost by the government cannot be sold for thirty years from the date of allotment. 

So better, go for land record so u can apply certified copy of land from land record dept in relevant place /district rest VI's a vise.

Dear Sir,

To be frank buying land belonging to SC/ST, irrespective of previous ownership, his legal heirs may raise some issues at any point of time.  Better to avoid purchase of such land unless you are going to purchase at its 50% market value.

Check whether the land was purchased from ST person with the permission by current owner and with keeping in mind the rules at that point of time. If land was sold by ST person with permission of appointed authority then you can purchase it.

If this land do not come under the category of free allotment to the SC/ST community then it maybe that the buyers belongs to different caste and community, hence there should not be any problem in buying this property.

However You may refer the relevant documents before a local advocate and get his legal opinion before venturing into the purchase.

1. Apply for survey and certification of the zone of the land, to determine its true status.

2. Also obtain village gat map & Form no. 6, of the land from 1950 onwards, which will show the history of the land.
3. Show the same to a local property lawyer and take his proper opinion, before investing.

The land initially belonged to a general category person, changed hands and went to a st person but now as per the records it belongs to a general category person.therefore it can be bought.
