• Power of attorney for an undivided share in a partnership

Hi

I have 25% share in a partnership firm.
I'm going out of country for few years and want to give POA to a third person who is not part of the firm
There is no specific statement in the partnership deed regarding POA
Kindly let me know if I can give an unregistered POA (without sale rights), or registration of POA is mandatory?

hello

      a registered PoA would be better and instead of a general, make a specific PoA. it is mandatory.

You can execute unregistered POA in favour of third party 

 

2) registration of POA is not mandatory if you are not giving any rights to sell property

Yes you can give power of attorney for daily work further specifying the work your agent can do under power of attorney granted i.e limited powers. Registration of this POA is not mandatory notarised is enough.

You can give a partnership to a person not associated with the firm

Such power of attorney is not required to be registered, provided there is no sale right for any immovable property in it
