• Parking issue in housing society

We have 5 buildings in single compound.
Each building has their own societies., and there is a federation above these societies. Currently we are facing some issues with our parking area. Our parking space is horizontal and adjuscent to compound wall. There is no parking written by society to adjuscent wall beside our parking. There is a small gap between no parking area and our parking. Visitors generally park there vehicle in this small space. So we cannot take our car out because of this. This alloted parking comes under federation or our building society? Can we write No parking on our own or do we need society permission?

the entire land comes under the federation

you need to write to your society first complaining about the issue and then request your society to take up the issue with the federation 

the federation need to pass rules in a general body meeting of societies that no member belonging to any of the societies coming under the federation or any of his guests or visitors should park their vehicles in such a manner that its obstructs the parking of society members

Sir society permission is required if the common area is under society then in that case the society need to pass a resolution for same and can bar the visitors from parking there and placing a no parking sign there,

You must be the member of the society and the parking lot for each society must have been demarcated. Therefore nobody can encroach upon the parking space of a resident. In case all the buildings do not have their parking lots demarcated then you have to talk to the federation so as to put up a notice that no visitor should park his car without clarifying as to the house he is visiting and the resident should take responsibility for the visitor.take the permission of the society and specify the parking.

1. Make a proper written complaint to the local Municipal & Fire Dept., authorities that the Society is parking beyond the ear-marked areas and beyond the sanctioned plans of the building and that it is a hazard to the residents.

2. The Federation has no role in Parking spaces and such parking issues are governed by individual societies rules and resolutions.

  2. I advice you to first please write to the federation and other society association concerning the disputed area.
  3. If they do not listen up or do not do anything then you may have to go before the civil court of law stating direction and injunction for those you are parking their cars to create nuisance for you all.
  4. Make federation and societies also part in the suit along with those who have been doing/ creating nuisance for you.

If individual societies are under the Federation then this matter should be passed in an AGM in this regard as the individual societies have no right to pass any resolution

You can make a representation or a complaint  about this menace to the association and request them to permit you to place the no  parking board on the empty space, which generally is admitted, while so, you may erect a board on the spot.
