• What is position and how to get clarity

I was working in UAE for 16 years and I had a liability which I was unable to pay. I had to leave my job to return to India to take of my sick mom since there was no one to take of her. Due to her critical illness, someone was always needed. Hence I was not able to seek employment and we were living off my mum's pension.
I know that I should pay my dues to the bank and I am willing to do so.
Recovery agents hired by the bank in UAE had contacted me. Please advise what should be my course of action to avoid harassment. Will they give me more time

Hello,

These bank in UAE engage agents in India who then adopt illegal means to harass you so that you return the amount. This is the common practice adopted by UAE banks for the purpose of recovery.

yes you may talk to them about settlement and if the agent here in India harass you further then you may go ahead and lodge a complaint against these agents.

is it Mashreq bank?

The Hon'ble Supreme Court, in one of its judgments, has come down heavily on the illegal and arm twisting methods adopted by the banks and financial institutions for recovery of their dues. The bank/credit card issuing institution is allowed only to take appropriate legal steps towards recovery and no illegal methods can be resorted to. Thus, if you are getting threatening calls, you can immediately approach the police authorities and file complaint against the recovery agents. Pls. note that, you can not force the card company to settle the matter on your terms.

Sir the recovery agents cannot take any coercive step towards you bank can only go for a court case for recovery of the amount they cannot file a police complaint or take or property or any thing if the agent harass you a police compaint agaisnt them can be filed. Further if bank goes for suit you will get time as litigation is long drawn in India,

1) You have to mentione this issue in the International Court of Justice that ICJ. And take more time from that court accordingl to bilateral agreement between both countries.

Dear Client,

From UAE, bank cannot do any thing. It will hire some recovery agency in India which will contact you for recovery but you can refuse, that also cannot do anything except demand.No remedy.

And through court, recvoery suit possible that will take time and will file in India. UAE court order will have no impact.
