I have a house for letting out on monthly rent. A srilankan Muslim who is on visitor visa is interested to take on monthly rent . What are the laws to be followed?

Get a lease deed prepared. 

Let the local police station do his verification and after that you may let out the property

You can rent out the property to foreign NATIONAL by keeping following things in MInd :

  1. Check the tenant’s passport for identity and make sure their Visa is valid and retain a photocopy of both.
  2. The landowner who is giving their property for rent to a foreigner should create a rental agreement only for the duration of the validity of their Visa.
  3. The landlord then must submit the details of the residing foreigner in Form C to the Registration authorities (FRRO)within 24 hours of the foreigner’s arrival at their premises.
  4. Police verification of the tenant.

There is a police verification form that has to be filled and submitted to the police station.

If they will have any objection then they will contact you otherwise there is no procedure of giving the consent in writting.

You should enter into leave and licence agreement

No such prohibition, all you need to execut proper rent agreement and also informed the nearest police station that you have let your house on rent to this person and also submit id`s of every member of his/her family.

There is no rule as such nor any restrictions 

 

So long as the person has a valid visa and authority to be in India, you can let your property to him on rent

 

As always, it is advisable to do a police verification of the person to whom you intend to rent your property 

 

Many police station have a fixed form in which details of the person are to be filled and the person has to appear before the police officer and produce his ID proof and thus get himself verified

 

This is to rule out that the person is not involved in any illegal activities and even if he is, he can be easily traced through the verification

1) Police verification is must for tenant in local police station is must before giving house on rent.

2) If ur government employee then government permissionis require before giving ur room on rent. Also take C form from the tenant. If tenant is diplomat then u cant sue him.

3) There is no such legal rule wrt giving room on rent to foreigner provided follow point 1. & 

4) The photo ID proof , Address proof and two reference from his local residence need to be considered, mobile no etc document require from tenant.

5) As per mutually agreed by both party decide Terms of reference of agreement. No need to incorporate special terms for the contract.

6) Law state that who ever do wrong act will be responsible for his own act and no other will be responsible for it. Owner is not responsible for any wrong act done by tenant.

You will have to get a leave and licence agreement prepared not later than the date of expiry of the travel visa of your tenant.

After that police verification and application to FRRO needs to be mandatorily given, if a property is rented to a foreigner.

        you can give him your house on rent but his passport and visa copy should be kept and sent to the police station for verification. the police will verify him. the [police will perform its investigation as it is a case involving a foreign national.

The person who is on visit visa if leaves the country you will not be able to legally enforce the rent agreement and at the same time you will not be able to get any police report about the person whom you are going to give the property on rent.

There is a risk involved in this and in case you want to go ahead with that then you can do it on your own risk
