• Wrong flat number in stamp duty Challan

Hello,

I had paid my stamp duty last week, which was done via builder. They mentioned incorrect wing in flat number. Due to this my stamp duty Challan got generated with wrong wing again flat number. The wing and Flat number is correctly mentioned in sale deed. Though the registration with the registrar is still to be done. What is the process to get this error corrected. Does it have an impact on loan disbursement from the lender? Will is have any problems in future if not corrected? Could a point be mentioned about this mistake in index 2 and we go ahead with registration?

Sir firstly the wing number wrongly mentioned on stamp certificate would not effect your ownership or title over the flat further you can get same corrected by applying before the Registrar of the stamps and it would not effect anything in future and neither on loan. In index 2 such points are not mentioned sir the colum on challan is just informative regarding the amount paid it should be correct in the sale deed.

in Case you have an E- Stamp it can be corrected by making an application at the E-stamp Stockholders Office. mentioning your detail and correction they may charge a little amount and reprint the Stamp Paper. 

Another way is to make the application to a Senior Officer (Asst. Inspector General) than Registrar, from where a direct notice will be sent to E-stamp office.

to be very simple it is better to get it corrected than to face difficulty in the future. it might take one day or two. 

while mortgaging the property everything depends on the Bank Law Officer if he is satisfied he will furnish the Loan and if he disagrees with any of those points than they reject the application then and there.

or if in case you have a Hard Page Stamp then a simple application to make a correction in the register of the treasury will make your work done.

If the sale deed is not registered with the registrar and all the details is correct mentioned in the sale deed flat number, wing, survey number and acorrect address along with flat area. Than it will not create any problem for you in future as well.

Stamp duty is for purpoase of area of flat that on how much sq ft area you have paid stamp paid that amount will be checked by Registrar.

Since wing number is wrongly mentioned stamp duty fir your flat has not been paid 

 

2) it woukd have impact on loan disbursement 

 

3) no rectification deed can be executed for correcting error in stamp duty 

 

4) deed should be cancelled obtain refund of stamp duty paid then fresh deed ought to be executed

  1. As per the information mentioned in the present query, makes it clear that wrong has been done now, but there is a way to rectify the same without going for any hassle procedure.
  2. Even if the sell deed has also been registered then also you have an option for going to the correction deed with respect to the change or coorection in the same along with an affidavit.
  3. But, here you may only have to give an affidavit to the effect that the stamp paper has got on the wrong address as of the address in the agreement.

If the registration is yet to be done, then you may seek to clarify and amend the details which were incorrect in the stamp duty challan. It can be made alright provided the Registrar permits the same.

Registrar won't make change on the stamp.duty as he has no jurisdiction over it sub registrar stamps has the power to rectify and make new. Yes it is good enough to go for registration .

Generate a new MTR challan

Registrar cannot rectify error in the challan

Clarify about error in sale deed as well

You can make an affidavit saying that stamp duty is duly paid on the document and there is an inadvertent error in challan in wing number and anned this affidavit to sale deed to be registered

The affidavit, if agreed by the registrar shall be a better option, or else a rectification entry has to be supplemented by the builder due to the error in the flat number and wing number.

U need to understand the both things ur document is different and stamp duty paid is different 

When u pay stamp.duty against a property it has to be clearly mentioned against whom the duty is paid. 

(Like a Car challan If car no. Gets wrong it won't be considered that challan is against the same car ) 

Same way instrument can say anything about the property terms and conditions but it cannot direct the stamp duty to go against whom. 

As later if by someone challenges that you have not paid the stamp against your property you wont get the benifit of your stamp duty.
