Supreme court has ruled that stilt area comes as common parking area as it is not included in the FSI of the property, so no property tax leviable on it.
I would just like to know if there is any Property Tax payable on the stilt parking area. The stilt parking are is strictly used for parking of cars only for Gf, FF,SF and TF. Thanks a lot.

Mr Ajay Seth and Mr Yogender Singh jee, its my own property with GF, FF SF & TF duly built In Delhi. I pay house tax on the all the floors and at the stilt parking only cars of the resident living in floors are parked. As per Mr Yogender Singh who also answered my question and has quoted- "Supreme court has ruled that stilt area comes as common parking area as it is not included in the FSI of the property, so no property tax leviable on it." So please please can you clarify with the judgement copy or a link i can download this judgment/ruling it from. As you can see its so much confusing as one learned advocate says no property tax payable and where as the other says it is. Please my learned friends bail me out on this. Thanks a lot.

Firslty, as per the information mentioned in the present query, makes it clear that that the tax is subject to certain condition when it comes for the house tax to be paid by the owner of the property.
Secondly, yes, as per the latest Supreme Court ruling it has been stated as no need to pay house tax in the parking area.
MCD does not give any rebate in case the ground floor is used for parking. You will have to pay the property tax
To the best of my knowledge the SC judgment is with regards to the stild parking given by builder in the residential society
1. Property Tax is payable, for all type of parking areas.
2. Parking area is free of PSI, and Not Saleable, as per Supreme court. But Property tax is not exempted for any usable and compounded area
3. Apply for property tax inspection extract with the local civic body /grampanchayt for detailed clarifications.

stilt car park spaces are indeed common areas but that does not mean that they dont utilise FSI
it is actually the open car park spaces (open to sky) which are also common areas but they do not utilise any FSI
if you see for a stilt car park, there is construction done i.e. the columns on which the building stands. That uses FSI
So property tax will be payable on stilt car parking and not in case of open car parks
