As per the rent a vehicle act passed in 1997 , it is legal to operate a Two Wheeler Rental Business in India , but you have the license for it.

There are quite a few formalities that need to be taken care - under the Companies Act, Service Tax registration and other tax related registrations etc. For the bike rental business application with need to be made to the Regional Transport Authority. Section 75 of the Motor Vehicles Act, 1988 provides for Scheme for Renting Motor cabs (which includes motor cycles).

RENT A MOTOR CYCLE SCHEME

•  The Rent a Motor Cycle Scheme, 1997 was issued by the Central Government in exercise of its powers under Section 75 of the Act.

•  The Rent a Motor Cycle Scheme grants licenses to operators and further provides for the grant of contract carriage permits to motor cycles operating under a Rent a Motor Cycle License.

•  These, however, cannot be utilised as bike taxis for point to point pick ups and drop offs. They are meant for an individual’s own use and must either by driven by the individual or a driver appointed by him. Section 75 of the Act gives the Central Government the power to formulate a scheme for renting of motor cabs and motor cycles by individuals for their own use.

So bike are meant for individual use and not for rent purpose.

Yes the act are applicable and a valid license of motor cycle rental has to be obtained from the concerned authority under the act to rent the motorcycle . Similarly the registration of the vehicles are done under the commercial category.

You need license for it, few formalities for obtaining license, apply before concerned authority under the act to rent the motorcycle . Similarly vehicles are registered under commercial category

Dear Client,

MV Act, extends to all over India and 1997 scheme is for Himachal Pradesh.

In Gujarat, to get permission to run this service, should have minimum 50 Bikes.

District Transport authority is the nodal agency for this purpose and you have to speak to the Transport authority to provide you licence in this regard an payment of requisite fees there is no ban on this kind of business

When other States leagalised such bike renting the Gujarat government cannot restrain such trade. You may approach High court if Transport department denies licence.
