I have moved after serving notice period.The letter came out after that on 26th Oct mentioning resignation is accepted wef 31st September .Can I be charged for double employment?
Sir write a letter to the previous appointing authority for correction of reliving letter if you served the complete notice period. If same is not done there wont be any charge but can lead to enquiry.
You cannot be charged with double employment as you left the organisation after serving the notice period
you will have to approach the company and explain your difficulty and based on that if they give you any authorized letter stating that inadvertently they have issued relieving order with incorrect date. That will suffice. If the company is out rightly declining to entertain your case then better send a formal representation letter to them.

Legally you were free to take any job w.e.f.Ist Oct. If 31st Sep has been mentioned then it is wrong date because Sep. always of 30 days, so don't confuse and sleep well.
Even if the resignation is accepted at a back date, the fact is that you can get relieving letter only the next date of your last working day.
Since you were physically working till the previous day, your reliving will be considered from the next day of your last working day only.

There are no 31 days in September.
If you were not working in the office after tendering your resignation letter then your last working day shall be 30 September, i.e., the effective date of your resignation as acceptd by your employer.
