Hi, I had availed a program with VLCC andheri centre, the payment method being Bajaj finance loan in April 2018 on an emi of 10 months. Out of the 20 sessions mentioned in the program i have availed only 3 till date and still paid and emi of 5 months. I am currently in a financial crisis and had to avail a personal loan for that. In this scenario, I am asking VLCC to cancel my loan going forward as i would be unable to pay the emi's going further. Also i havent even availed as many services so it is only fair to cancel the loan going forward so i am not burdened with any more emi's. But they are being too adamant and insensitive and wont do that. Seems like.they just want me to pay the emis for another 5 months whether i avail any services or not! I even wrote to their head Monica Bahl, but no response. Bajaj is all ready to cancel.the loan, but they need an intimation from the merchant(VLCC). I have been emailing and talking to VLCC people for the past one week with no good response. What can i do in this case? I just cant pay any more emi's. Also it is not something that i have already used and not paying for. They are just keeping me bound! Also, their receipt which mentions non refundable, was sent to me on the date i raised this issue. It was never sent fo me before that. Please let me know what i can do, i really cannot afford to pay the emi unnecessarily.

You must have signed some paper during taking the program. Is there any clause that you can cancel the program and get a refund in between the program also?

Usually once you take a program there is no policy of refund unless and until fault has been on the part of the service provider.

However, if there is such clause that you can take back the subscription in between then you can file a case in the consumer forum against them.

1) issue legal notice to VLCC to cancel the loan amount as you do not want to avail their services

2) if they refuse file complaint against VLCC before consumer forum and seek orders to direct VLCC to cancel loan amount as services are not being availed of

This is my response to you:

1. Send them a legal notice;

2. State in the notice that they have committed fraud on you;

3. State the non-refundable part was never mentioned to you;

4. Also seek full refund and compensation for the mental and monetary loss suffered by you;

5. This kind of act is not acceptable and they should resolve it immediately;

6. If they do not then go to consumer court or civil court and seek justice there.

Send them a legal notice calling upon them to deregister you.

Having said the above, this will be governed strictly in accordance with the agreement you signed with VLCC.

1) Draft an email whatsoever you have stated above mentioned all in details date wise chronological order and send that email to consumer forum one email plus another to RBI.

Keep cc'd Bajaj in RBI's email and VLCC in Consumer forum email.

when you avail any services you generally do so on certain terms of the service provider

so once you have paid for the services, you cannot ask for a refund

in your case you paid for the service through loan from Bajaj finance. The lender paid the merchant and you as customer are entitled to avail the promised services

so once the payment is done the customer cannot tell the service provider that he does not need the service and therefore his money should be refunded

if this is allowed then it will become very difficult to run any business

even if you go to court the court will say that the service provider is not denying you its services and you are free to take its services and that the loan is your liability for which you cannot make the service provider be at a prejudice

so sorry to say there is nothing legally which can be done in your case

you can keep on requesting VLCC to accede to your request on compassionate grounds

Your efforts through email and personal approaches will not yield any fruit.

You have to initiate legal steps to curb this menace.

You communicate your decision to cancel the loan by sending it through a lawyer.

If this fails to fetch any response or if they dont comply with the demand made then you may legal steps through consumer forum by roping in the VLCC and their chairman as parties and seek relief and remedy
