If one person under probation is absent without leave for 180 days he can be terminated.
Sir I have joined indian railways as junior engineer on january 2016 and completed the 1 year training and now being posted in kharagpur workshop. I am currently under unauthorised leave from december 2017 due to medical and family problems and dont wish to further join the railways. In july 2018 i got a letter regarding major chargesheet and enquiry has been conducted in which i am not participaing. Since i am under 5 year bond period and i have not resigned yet but as the situation arises ihave been told that i will be removed from service after the enquiry so i want to ask followinf questions: 1. Whether after removal from service i have to pay the bond money or not? 2 Removal from service will have any repercussions on my further employment in any government job or even indian railways? 3. Should I resign now but I dont have the capacity to pay the bond money which is approx 5 lakhs.. then what should i do? 4.Will my resignation would be accepted as major penalty enquiry is ongoing?
1. Yes you have to pay the bond money as you have wilfully absconded from the job.
2. Yes as the disciplinary proceedings.you can be barred from joining further government services.
3. It is better to reign and pay the balance amount as per the terms of employment and further pray for waving of the bond amount due to your conditions and problems.
4. Yes you can resign.
Your resignation would not be accepted as enquiry is pending against you

This depends on the language of bond, bond price payable on resignation within 5 years or also applicable on termination for your XYZ conduct.
Reason of removal shall be taken into consideration only if new emplacement recruitment rules speaks, otherwise no effect.
Don`t resign at your instance, otherwise bond money payable.
Resignation shall be accept on your willingness to pay bond money.
First challenge the ex-parte enquiry proceedings in the court then decide to resign because they have removed you from the services arbitraryly.

3. In any way they will ask you to pay the money, if you will not pay then a recovery certificate will be issued against you.

1. If they send a legal notice for recovery of the training expenses then you may have to reply to the notice accordingly before they proceed through court for recovery.
2. It depends on the reasons for removing you from service.
3. You can send the resignation, let them send a notice for settlement of bond amount, you may tackle the issue legally accordingly.
4.Generally resignation will not be accepted during the pendency of any departmental enquiry before conclusion.
