• Affidavit on special adhesive stamp of Rs. 5

The life insurance company is not releasing the payment of death claim under husband's life insurance policy due to the surname of my husband's father is wrongly printed on death certificate. The claimant has submitted a notarized affidavit regarding this on special adhesive stamp due to non-availability of non-judicial stamp paper locally. However, supporting several other documents attached to the death claim papers viz. D/L, Aadhar card have the same surname as mentioned in the policy . I simply want to know if my notarized affidavit submitted to the life insurance company is of no use.

Dear Client,

These are tactics of insurance company to delay claim, affidavit merely on plane paper or on the stamp of 50 Rs. notorised sufficient to clarify name dispute. Still disputed than consumer claim.

Another way out is to get the name correction on death certificate.

Non judicial adhesive stamps and non judicial stamp papers carry equal value. Here it may be asserted that in case the document or instrument attracts heavy stamp duty then non judicial stamp papers should be used as adhesive stamps Cabot he affuxed over certain limits as per state laws which may vary from state to state.

1. Yes, this is very much valid and the Insurance company must act upon it.

2. if ti does not still release the fund then send complaint to IRDA.

3. If even this does not help then file a writ petition in the high court. You will get back your money.

Make your affidavit on 10 rupees stamp paper and get it notarized and then submit to the LIC office

Affidavit must be on Rs. 100/- non judicial stamp paper only. Along with that it should be notorized. This is the procedure. So you should submit it on stamp paper. Or you can attach the blank stamp paper by crossing it with the affidavit and get it notorized.

Or another option is Franklin. You can do the franklin of the affidavit you have already submitted.

If there is no non judicial stamp paper then you can also have the affidavit document franked for the required amount of stamp duty

If the insurance company is insisting on the specific non judicial stamp paper alone, then you may procure the same from the nearest available source to complete the requisite formalities.

Have you submitted the current affidavit in your possession to the insurance company, what was their reply?

If they are rejecting the claim for any illegal reasons, you may resort to legal action against the insurance company through consumer forum.
