Hello sir , it is advisable to file divorce on the grounds of adultery ... However you will need sufficient evidence to proof her relationship with brother in law ... You can take a help of a detective agencies to track her movements...
This is my response to you:
1. You will to file for contested divorce in the district court nearby;
2. File the divorce petition and also lay down the main ground rules for divorce;
3. The grounds would be adultery, cruelty and other relevant grounds to your case;
4. Also, file complaint to the police station for her attempt to commit suicide otherwise the blame would come on you;
5. Make sure you take legal steps in a well mannered way so as to avoid any complication for you.
Section 13(1)(ia) of the Hindu Marriage Act 1955, provides:
13 Divorce —
(1) Any marriage solemnised, whether before or after the commencement of this Act, may, on a petition presented by either the husband or the wife, be dissolved by a decree of divorce on the ground that the other party;
(ia) has, after the solemnisation of the marriage, treated the petitioner with cruelty;
Filing divorce on grounds of adultery requires a lot of evidences, hence filing on such grounds should be avoided, if you do not have specific evidences which can prove her adulterous relations.
It is difficult to lay down a precise definition or to give exhaustive description of the circumstances, which would constitute cruelty. It must be of the type as to satisfy the conscience of the Court that the relationship between the parties had deteriorated to such extent due to the conduct of the other spouse that it would be impossible for them to live together.
For any other queries feel free to call.
Regards.
