As a follow-up question I retrieved pahani and mutation record from district subregistrar, below are details.

I see Mutation Type as ' Podi' and Acquisition Type as ' Vibhajane'. So is it OK to buy this land?

Hello,

Yes you may go ahead and purchase the land. Vibhajane means that the mutation has been done in furtherance to a partition.

Dear Sir,

It means that it was mutated on the basis of family partition. If Podi is effected and sub-numbers are given as per partition then it is OK. As a retired judge I suggest you not believe these records. There are so many issues to be looked into. Please get the bunch of documents to Bengaluru and get it verified physically and in the meanwhile originals to be verified.

It is advisable that you get done a title search of the property through a lawyer.

Then it is very difficult. Unless such word is removed it cannot be purchased. "Sarkari" means "Goverment". Patta means Ownership. Thus at present it is owned by State Government. It happens some times m=by mistake. But such word must be remored by appraoching office of Asst. Commissioner, Revenue or Karantaka Administrative Tribunal (Revenue), M.S.Buildings, Bengaluru. If land revenue is not paid then the government wrote such word. Please come to my office for clearing your doubts also bring the seller so that I can clarify the points and ask him to bring all documents. Please come to my office in Bengalure. If sarkari is mentioned then it means that the land is in the name of government.

Get the same rectified.

it might be there by mistake or the revenue of the land has not been paid to the government.

Whether this term is okay or not will be confirmed by a local advocate hence it is always better to have a legal opinion on such aspects from a local advocate since the terms involve local issues.

One more question in 'Hakkugalu(or rights)' column of pahani. I see comments as 'Based on subregistrar direction a pahani has been registered dated 21/2/2009 with mojini CR number 13/07-08'. What does it mean? Should I go ahead and buy?

Purchase of immovable landed or house property shall not be based on the revenue records, but it should be based on the registered title deeds only.

You may obtain a proper legal opinion before venturing into this purchase especially if you depend on the revenue records for clarification of the local technical terminologies.

In mutation register sheet, I see a column patta under which it is mentioned as 'sarkari'. So what does it mean?

It may be a government promboke property also, which means that the holder is occupying the government land for a long time or the government land was allotted to him by a patta
