What did the termination clause in your employment agreement with Indigo reads?
In any case, do not pay-up anything to them at this stage. You can respond when they issue you a demand notice. Even if they take a legal recourse against you, you will have ample of opportunity to defend.
Just stay calm at this stage and let them the legal action, which they intend to against you.
It is a breach of contract and either of the parties shall always have the right to claim damages. Therefore, it is the bounden duty to honour a contract. Negotiate and get out of the mess.
1) Have you signed contract agreements that is MOU between you and company.
2) have you took training from them and left organization and joined elsewhere?
3) If the legal action is take than you have to pay training cost to the company for 4 months.
What is the term of resignation.
And reason for resign ?
WELL, avoid company claim. Most of such claims are hollow and rarely taken to court by company.
Wait until no actual claim is filed.
Hello,
You are not required to do anything if you can not pay the same.
Did you serve the notice period?
Anyways let them file a case and then only you can defend the same in order to show your case before the court. However, if you receive a legal notice at any stage, tender a reply to the same and if they threaten you then lodge an FIR against them in the nearest police station.
Regards
If there is a bond to work certain period or you agreed for a notice period to serve you need to fulfill clauses of you agreed to take up the job.
As you left the job the organisation have the opportunity to recover the amount as per the terms of employment and please note that this is always two way. So negotiate with the company and try to reduce or waveoff the amount and save any legal action.
1. What does the contract of employment provide for? Is there a lock in period or notice period? Usually there is a clase of liquidated damages in such contracts.
2. The employer can sue you if you have resigned in violation of the contract.
What is the condition on resignation which would have been signed by in the form of employment offer letter?
have you not served the notice period?
You may see to it that during probation you may need to serve only one month notice period or to pay for that, hence you confirm this and approach your HR about this.
Hi
Answer to your query it in your hands i.e., your appointment letter contains the Terms & Conditions (T&C).
Peruse the same, it will be give clarity.
Other way round, share the same we will be able to guide accordingly without which it difficult to guide your correctly.
Coming to your point of quitting within 4 months, how did you resign i.e., is it in line with the T&C of your appointment. If it is in accordance with T&C you are safe.
All said and done, without perusing the T&C you will get only half backed guidance.
You can as well share the same with your local advocate who will be able to guide you properly.
Good Luck
The details furnished in your question do not disclose as to on what context they are asking you to pay the said sum. If you have been trained at the cost of Indigo to do the job which makes you eligible to do similar sort of job in other organisation as well then you are required to pay this sum.
However, if there is no training imparted to you on the cost of Indigo then you are not obliged to pay this sum. Further, to have any sort of this obligation it is mandatory to have an agreement in between you and the company duly signed on a stamp paper. If it is not there then again you are not required to pay any sum to the company.
