What would be the type of partially covered parking area? stilt or open parking? 

The scanerio :
The top view of the building is like alphabet H. Outof 2 open pockets in H like building structure, one of the pocket is having half bedroom starting from 1st floor. Part of that bedroom covers some 4ft+ in that open pouch. And same pouch is covered as grill concrete design or structure at top most floor I.e. 13th floor. The property is in Mira-Bhayander Munciple Corporation.

So can we consider the space exactly below that bedroom and within that pocket at ground level as stilt parking?

for example out of 10 feet around 4 feet is having concrete slab and 6 not covered but all 10 feet area is covered as grill like concrete structure at top most floor and this entire 10ft area is in building layout.

It would be regarded as stilt parking slot

2) space which is not open from top,ie it is under the stilt or the building constructed for the flats. It is having a ceiling. It is having a roof on its top

Its to be seen what has been described this pocket in the sanctioned building plan.

If this portion is shown as open space then the same can be used as stilt parking. Otherwise without the consent of the society or association it can't be used as such.

Although the building plan has to be perused, but from how you have described the space it should be regarded as a stilt parking as it not open.

Hello,you can not assume an area to be a parking area. The same will be decided as per the sanctioned plan of the building.

Also, ask the builder to provide you the sanctioned plan and tell you as what is the parking area as passed by the municipality.

Maharashtra RERA rules defined parking as : “Covered parking space” means an enclosed or covered area as approved by the Competent Authority.

Open Parking – These are uncovered parking spots within the apartment complex premises.

Stilt Parking – These are partially covered parking spots on the ground floor of the apartment complex.

Garage Parking – Fully covered complete parking structures

If we try to park the car in the pocket then only 4ft gets covered by proper concrete slab and rest portion of the car remains open and gets covered by grill like structure with sqare open strips at 13th floor or topmost floor.

Since it is not fully covered it may be considered as open parking also.
