• Forgery

(1)my grandfather holds a sale deed dated 24/3/1982 and also land is in possesion from that time to recent days

(2)when my grand father died in 2011 afterwards my 
Family residing in other state for education purpose

During this period some miscreants(goons) type villagers manage the bataidar(cultivator) with some lucarative options and later when we reach the spot 
In recent days those miscreants type people (goons)
claim that this plot of land is already sold to them in sale deed dated 11/9/1919 by father of person from whom we bought this land in 1983

(3)when i go through enquiry of sale deed dated 11/9/1919 from registrar office and also revenue office and COLLECTRIAT OFFICE then i come to know that these miscreants(goons) type people disturbed or torned the original deeds relating to sale deed of 11/9/1919 in registrar office and put a newly

11/9/1919 deed in registrar office in volm-73 pg no.-68 to 72

(4)when we go through village panchayat(some old people gathering) those miscreants type people (mafia)show fabricated original sale deed which is totaly fabricated document and i demand photocopy of original sale deed of 11/9/1919 when they give
 photocopy of original sale deed then i went to different finger print expert then all experts say that not only fingerprint but total deed is fabricated

(5)all miscreants(goons) want to occupy my land by muscle power 

(6)i also reach to local lawyers for suggestion but i
am not totaly got satisfied becoz i went for suggestion on forgery issue some of them give suggestion on title suit issue that if father sold the said land in 1919 then son can not sold in 1982

You have to file Police complaint of cheating,forgery , fabrication of documents against the fraudster

2) also file declaratory suit that you and other legal heirs are owners of land and to set aside fraudulent sale deed

3) seek injunction restraining sale of land by fraudsters

Firstly, it is the case of forgery at the first instance.

Secondly, when you would go for forgery complain try to give all the related documents which shows that you and your family was in possession, and it is only few years back you went to some other place.

Thirdly, if they are saying that they bought it in 1919 then why did not they turn up for almost 100 years.

Lastly, and also would suggest you to go for one civil suit also for right to possession as both the cases can go simultaneously giving different relief to you.

You can file civil suit as well as criminal complaint in a court of law.

You can file civil suit for title, possession, injunction and mesne profits under which remedy is to solve the matter by way of providing the land to the right person.

On the other hand you can file criminal complaint for forgery, cheating etc. under which court will punish them by way of imprisonment.

Hi, the procedure involves criminal proceedings .. First , file a FIR against the person under 467,468,471 IPC for fabrication of documents with illegal tress pass over the property ..why should you approach court to claim your title , when you were in the posession of the property . It is a case of illegal trespass and it is advisable to oblige local police and get a FIR registerd agianst them

Hello,

It is a straight case of forgery, go to the police station and file a complaint for forgery, cheating etc and give all the related documents which will depict the cheating on part of the said person and that your family was in possession.

And simultaneously file a civil suit for declaration that you and the legal heir are the actual title holder of land and seek injunction restraining the sale of land.

If you have original title deed in your possession and also the property is under your possession, then yo should immediately file a mandatory injunction suit u against the so called goons seeking to restrain them from interfering in your possession and enjoyment of the property without any semblance of right or interests in the property

If local advocates are not cooperating or not guiding you properly then you may aproach an advocate outside the town for the purpose.

You can also lodge a criminal complaint with the police if they are very arrogant and use force or violence against you people.
