Take Civil injunction.
I m a resident of delhi living in 2nd floor. Resident of fist floor has put a water pressure pump on roof which is common. Whole day & night as they use water it automatically come to on position creating lot of vibration disturbing our peace during the day & night. What should I do or where to go as he is not listening after several reminders.
If this is causing nuisance to you, send him a Legal Notice calling upon him to forthwith remove the installation of this pump or not to use it during odd/wee hours of the day.
If he doesn't listens to you despite the legal notice, you've remedy against him, both under civil and criminal law.
This amounts to nuisance
Send a legal notice to him for prohibiting himself for such act
failing which you should file a suit for permanent injunction alongwith a criminal compliant for breach of public peace.
Let me know if I can be of some help.
Regards
Hello sir , you can give a complain to the muncipal corporation as well as to the police officials .. If nothing is done by both the departments , it is advisable that you file a complaint at the Lok Adalat .. The Lok adalat judge has the power to summon the parties and make them settle the matter ..
1) complain to municipal corporation against your neighbour
2) file private complaint with magistrate against the neighbour against nuisance created by constant vibration of water pressure pump
File a civil suit for permanent as well as temporary injunction, and get stay on their act.
If they do not follow the order then will have to jail for not complying with the court orders after filing one application for not compliance of the order by them.
Sir,
First of all I would like to know whether it your owned or rented property. If rented then the complaint should also include landlord.
Else complaint to the housing society, or resident welfare association along with copy to police station.
If not sorted out can file a suit for injunction/restraint.
You can file suit for declaration, injunction and abatement in court of law. Or you can file criminal complaint in court of law for creating nuisance.
