• Suppression of previous employment of 3 months

I have worked for 3 months in a private company from July 2016 to October 2016. After that I left without paying the bond amount of Rs 2 lacs. So they did not give me a release certificate and marked me as absconding. I didn't send them a formal resignation letter either as I didn't want to pay the bond amount. Now I have been selected in a PSU bank and about to join in December 2017. I haven't mentioned about this employment to the bank till now, in any form. But I am worried that the Bank will find out when they search using my UAN number which is fixed. And I am scared that they may terminate me. What should I do? Please guide me.

There is difference between concealing something when specifically asked for, and not-disclosing something when the same was not mandatorily and specifically asked for.

If you have not concealed this, in the sense they sought to know information about your past employers, and you concealed the factum of your 3 month stint with this particular employer, only then you may face a problem.

You need not worry otherwise.

Suppression of material facts is ground for termination from service

2) pay the bond money of Rs 2 lakhs to company

3) reach an amicable settlement with your ex employer

4) your employer would accept your resignation letter and give you a relieving letter

Well due to non disclosure of previous employment which is material information the employer can initiate disciplinary proceeding.

However since the same is no offence involving moral turpitude i do not see any reason of termination of job.

This is not a big issue you need not to worry about it ..Have they send any legal notice to you ...If any one ask from you about the bonds and etc you will have to just give only one valid and strong reason because which you have left the job ...Can can mention any family problem etc etc and noo need to worry most probably that will not quary such ...

If you know that there is a system which can disclose about your previous employment then I think hiding the details was not a good idea. But now that it's done ,

Solution can be , pay the bond amount , get your releasing certificate, and submit that certificate if asked by your present employer.

2 lakh is not a big amount in front of a PSU job.

1. You run a huge risk of getting terminated even after completing several years of service since if it is found later on that you have suppressed vital information while applying for the said PSU.

2. Once you arte terminated from the PSU, you shall not get any job with any govt. Organisation of Govt. Department.

3,. It might be difficult for you to even get a job in pvt. companies after being terminated from the PSU.

4. It will be prudent on your part to settle the matter with the said Pvt. company and then start applying for employment afresh to escape from anty probable disastrous consequences in future.

1. It will be very risky for you to join the PSU as it is for reasons explained in my earlier post.

2. It shall not be prudent on your part to take such high risk now.

3. You can join a pvt. company for some time and then get release order from it to regularise the absence of release order from your earlier Pvt. Company where you had worked for just 3 months.

4. Once the problem is settled either by negotiating with the earlier Pvt.Company or by joining a new pvt. Company, you can apply for and join any PSU or government department and work their being free from any tension of being terminated.

No need to worry. At anytime any complication arises due to this concealment, this can be well handled, depending upon the legal action which the Bank takes against you. Be assured, this could never conclude in your termination.

If the bank finds out that you have given false information then the bank will take action against you and there is nothing in law to protect illegality.

Though you can contact a layer when you receive the show cause notice (if any) and then can challenge the said proceedings.

It is not necessary to inform the PSU bank about the previous employment with the private company and that too you hardly served them.

You are not required to even obtain NOC from private employer for getting recruited in the PSU bank.

The bank has no such rules to verify your previous employment especially with the private sector.

The bank will be concerned only when you claim any benefits of the previous employer with the current employer and for that also you need to have served the government establishments

So your worries are unnecessary.

Yes, they asked the details of previous employment, if any. And also asked to provide documents for the same. Since I didn't have any certificate to show, and the time period was also less, only 3 months, that's why I didn't mention it. What possible options do I have now?

That is just for the formality sake and to ascertain your character and antecedents that way.

Since you have not revealed anything about it you dont have to be worried about it.
