• Stock broker not giving me returns, not refunding my principal amount

Respected Sir/Madam,
I have been cheated by Ahmadabad based stock broker for huge amount. They promised me 15% returns per month from commodity market(Gold). Now its 2 and more months on they are not reachable. It appears I have been cheated with a huge amount which is very crucial to me. They are not contacting me and they have put my mobile number in block list(might be). So not reachable at all. I wrote several emails and SMS to them but no reply. I sent registered speed post to Ahmedabad which was returned back to my address saying insufficient address. Long back they told me that my account is in loss and can not refund. But it was a Guaranteed Profit Scheme Service as they declared and has nothing to do with loss or gain they incur.
I request you all to advice me to recover my money without which difficult for me to cope. Money was transferred online to two bank accounts on the name of company.

1. You may file a criminal complaint.

2. If he is a registered broker register a complaint with SEBI.

You must urgently file an FIR against the said broker, also you may then request the SP of the city to transfer the case to Economic Offences Wing.

1. This is a criminaloffence which only the police and not you are equipped to delawith.

2.So lodge a complaint of cheating and criminal breach of trust with local police.

3.once FIR is registered and police proceeds to nab the culprit you may reasonably expect your money back.

You have number of option left you can send then legal notice you can lodge an FIR against under section 420 of IPC and section 66-C,D of IT act ..You might have some proof in this regard you can also file a recovery suit against them ...

No need of worry your money will be back to you ..It might take some time but it will be all yours..

The matter can be reported to Stock Exchange who will initiate proper action if the stock broker is found wanted in misappropriating your investment. Secondly you can lodge complaint with the concerned District or State Consumer Dispute Redressal Forum/Commission as per the pecuniary jurisdiction.

1. Firstly send a legal notice through lawyer.

All legal action can only be taken once notice has been served upon the entity or individual you wish to take to court. It is only this process that legalises bringing a matter to court. The intimation sent is known as a legal notice.

A legal notice is, therefore, a formal communication to a person or an entity, informing the other party of your intention to undertake legal proceedings against them.

This notice, when sent, conveys your intention prior to the legal proceedings and thus, makes the party aware of your grievance. Many a times, a legal notice served will bring the other party on heels, and the problem can get resolved out of court too, with fruitful discussions on both sides.

And, if the other party is still not heeding to the grievance, one can always start the court proceedings after a particular interval, as stated by the law.

Although a legal notice can service as a purpose of negotiations between the parties and save time, effort and money that are usually spent in court cases.

As far as I concern, None of the stock brokers in india would promise you on returns.

In case, if you are assured for guaranteed return then issue legal notice to them by RPD, Email and whatsapp(if any) in the process of recovery of fund.

By parallel, You can initiate criminal complaint with cyber crime police for this act.

Lodge a FIR in the matter with the concerned Police Station for you have been cheated and defrauded by these agents and have been duped off your hard earned money.

Moreover, you should send a legal notice to these agents for recovery of your dues.

There is no guaranteed returns from the stock market, if somebody promised then you should have become cautious about it.

The 15% returns is a greedy issue hence this has caused you the loss.

In no circumstance any investment can fetch you any returns that too this exorbitant extent

Further the investment in stock market, if suffered loss, cannot be claimed

If you have any agreement between you and the stock broker, you may file a money recovery suit on the basis of the agreement provided the contents are legally enforceable.

You can lodge a complaint with the SEBI too if you have the broker's particulars with you.
