• Unable to identify my own land

I have land in raipur. But we are unable to indentyfy that.. I got married 2007 and divorced .. And my husband is legal lawer at raipur court . at the time of marriage our given that land as a gift to me ... But after divorce i came to my parents place for further study as i got married at 14 years ... And we one girl child ... He got ex party divorce ... For my future i want sell that plot ... But he is a legal advisor ...no body is ready to help me ... And also m not getting any mantaince for my daughter ... Kindlg adivce me on this matter ...

1) file application under section 125 cr pc and seek maintenance from husband

2) gift deed executed in your favour must be containing schedule which would contain details of the land

Consult with a local advocate. It never happens that if some persons to take advice against an advocate no advocate is ready ti help the litigant.

You must not have consulted with the right people.

I am sure you have the original title deed with you .If yes then visit the local Revenue Authority can check the map pf the locality. It would be clearly demarcated in the map lying with them.

You can take help of local land broker who are conversant with the locality.

So there are many options which you will have to explore.

Contact a local lawyer who works at the sub registrar office, he will be of proper help.

Otherwise as k the registrar office to demarcate your part of land, on the basis of the land documents.

If the daughter is living with you and you have re married then there is no point to claim the maintenance, as the court usually do not give maintenance when the daughter is living with the mother and the mother has re-married.

But you may still try and file the maintenance on behalf of your daughter.

Hello, you can get information about the marking at the tehsildar office .. Approach any elder of your family or relatives who will be able to help you find out the location of your land .. If you have remarried you cannot ask for maintainance and alimony

Do you have the documents of the property that was gifted to you?

Was the gift deed executed by a registered document?

Do you know where the property is lying?

Have you applied for maintenance under section 125 cr.p.c.

Though your ex-husband is a lawyer, it will not in anyway forbid you from claiming the property that is lying on your name.

You can take the assistance of a local lawyer and get his advise on practical issues.

Now i am married again one year back ,Can i get maintenance for my child future or full and final settlement ? And i have duplicate land documents but unable to recognize find my land, As i want to apply for diversion but main patwari also not helping me ...As he was saying he also locate the land , As there is 5 plots and its big ground , Who will help me to take proper documents .

You can file a petition for maintenance of the minor child under section 125 cr.p.c. from its biological father if you are not able to maintain the child's expenses.

If the patwari is not cooperating then you may approach the Tahsildar for seeking his intervention and to direct the village patwari to identify the property as per the village revenue records and also submit an application to survey the landed property through the government surveyor.
