• Suicide harassment of wife to husband

Hi,
Just wanted to keep it short. One of my closest relative is facing an suicide harassment from his wife constantly if any quarrel rises up.. The reason for quarrel is most common among all families not due to dowry or something.. fact is she attempted thrice before but was saved. We didn’t lodge any police complaint citing family situations. The time period between those attempts are very large.. They are married together for more than 15 years and have two children. Wanted to know if she commits suicide what are the charges my relative may end up with and how to safe guard against it..Looking forward for your legal advice.

Hello,

In law there is no provision of doing something beforehand.

In sich situation your friend might just inform the nearest police station about the same also he might just take her wife to psychologist for some counseling session.

Such prescription of doctors will be helpful if something happens in future.

1) husband should file for divorce on account of wife constant threats to commit suicide

2) he should stay separate from her

3) if his wife commits suicide and leaves a suicide not implicating her husband then he would be booked for abetment to suicide

1.If she commits suicide and complaint is lodged agaisnt her husband and in laws then they would be charged with abetment of suicide.

2.Howeevr mere committing of suicide is not enough unless it is shown that the person was driven by constant torture to commit suicide.

3.if the person committing suicide is a mental patient then there is not much to worry.

4.Your friend must try to save marriage and keep his wife happy.If he thinks in terms of saving himself then this marriage will be affected most.

Hi, the first thing to do is to file a police complaint regarding it, as commiting suicide itself is a punishable offence ..there may be a serious problem if she commit suicide for the in laws

He may be booked for abetment to suicide incase this female actually commits a suicide someday.

To be on a safer side, he could pre-inform the Police of her suicidal tendencies. This could be anytime, or at the time she attempts a suicide the next time. Even attempt to suicide is an offences punishable under section 309 of the Indian Penal Code and hence, he may approach the Police and ask them to lodge a FIR under section 309 against this female.

1. There will be no problem for her act of attempting t commit suicide, if she is saved unhurt.

2. there will be serious problem for your relative if she finally succeeds in committing suicide. He will be surely taken under custody and charge of abatement to commit suicide may be imposed on him if inlaws so complaints to police.

3. It will be prudent on his part to audio/video record all such threats given by her continuously preferably with the admission that she has already attempted such acts and your relative has saved her.

4. Thereafter your relative can lodge a police complaint alleging her threats of committing suicide on trivial issues.

5. Such attempting to take extreme measure can be the result of psychiatric problem for which she should first be taken to a psychiatrist and if his prescription mentions such symptom of psychiatric ailment then ty will save you to a great extent later on since you shall be able to prove that she had this psychological ailment of committing suicide.

It is advisable that your relative should notify the local police about her suicidal tendency.

If she attempted suicide three times she may try to attempt the fourth time also.

Involve elders from both the sides to reconcile the difference between them

If the problems are not getting sorted out and ther is no solution for this then he may decide to even dissolve the marriage instead of experiencing tortures and harassment every day.

You can advise him appropriately to bring an end to this continuing problem.
