• Related to love marriage

My sisters daughter who is 20 years has left the house & gone with a person whom she is loving in spite of repeated advice not to do so as he is uneducated & she is perusing her B Com final year & taken CS. Her father has abandoned both wife & daughter & staying along from past 4 years. 
While going she has given it in writing that she is going out on her own without any pressure & there is no liability on us & neither she would like to claim anything from us, this has been signed by her & some representatives who had come to take her.
similar letter has also been given by the boy who has taken her.
in case if any mishap happens later will we have any problem should we go & inform in a police station that such a thing has happened & record it for us to be safe later.

Hello,

Yes you may tell this thing in writing to the police station and may tell them the fact so that they take the same on record.

Also if you want a concrete thing to happen then you may file a writ of habeas corpus in high court saying that your daughter is in illegal custody of that person, whereafter notice will be issued to that boy and after they appear in the court undertaking will be given by them which will be taken on record.

She is an adult who is capable of exercising her choice as to Marriage. She has also attained the marriageable age. There not much in your hands and the hands of your mother.

Informing or not informing the police does not make a lot of difference. Things were different had she be kidnapped by this boy, and then to inform the Police.

1.Since your niece is adult she can take her own decisison and you can stop her from taking independent decisison including marriage.

2.Whether anything happens or not your right to lodge complaint with police or seek remedy remains even if they gives such written undertaking.

3.Now if she si safe and happily married there is no need to go to police.

Since the girl left her maternal home for the sake of marrying a person of her choice on her own, this cannot pose any problem to you all in the present or in future.

You need not take any action on it.

She can initite legal action if you still keep torturing her for her act.
