• OBC non creamy layer criteria

Dear Sir/Madam,

Kindly advise me on the following:-

“How will the income/wealth test apply in case of wards of a parent employed by a society run private school in the post of Head Assistant carrying the grade pay of Rs. 4200/- (level 6 in 7th CPC Pay Matrix)”

Please note, the school has adopted Central Government Pay Scales/Grade Pay and now Levels in pay matrix in accordance of 7th Pay Commission.

since parents is employed in private school if his income from salaries/ from other sources is less than Rs 8 lakhs per annum then the ward would fall under OBC NL

if the income of the parents if less than Rs. 8 Lakh annually (excluding agricultural income) then you will fall under non creamy lawyer and otherwise not.

if parent are salaried person then their income shall not be taken under consideration for determination of creamy layer. in father has promoted at class 1 post or class 2 post before age of 40 years then without calculating the salary his children will come under creamy layer.

The income through salary is not considered as income from family members, the salary income is not included while computing annual income for all other sources.
