• Permissions required for installing solar water heater

Sir, I want to install Solar Water Heater on the roof top of our apartmet. The apartment area is 4000 sq.ft. and the space required for installation is 400 sq.ft.apprx. The construction of the bldg. is load bearing type and is 65 years old but still it is very strong. The water required for heater will be utilised from our quota. But Society is not giving permission citing the reason of old bldg. and extra electricity charges. What should I do?

You need permission from society to install solar water heater

If society has refused to give permission you cannot install solar water heater on your roof top

1.The the strcutural stenghth of the building verified aby a certified enginner.

2.If it certifies that the building can take load of such heater then on the basis of its report you can seek permission.

3.if the society nevertheless disallows such installation then lodge complaint with the registrar of Society who would adjudicate the dispute.

4.Anyone aggrieved y such order of registrar though can challenge such order in high court and then in supreme court.

So act accordingly.

Hii, the solar projects are being promoted and encouraged by government in different states .. The solar projects are neither load bearing nor they are high consumer of electricity .. The society cannot restrict you from doing so.. You can file a civi suit for permanent and tempory injuction against the society

If the society is not allowing you for the reason of old structure then nothing much can be done about the same.

Though you may go ahead and try your luck by filing a complaint before the RCS.

Aggrieved by the order of Society you can further challenge the order in HC and then in SC.

You are being denied permission because terrace is a common area and everyone has an undivided interest over it.

Propose to make a one-time payment for use of this space.

If the society still does not grants you the permission, approach the Registrar of Societies and move a complaint.

The society cannot refuse to allow you to instal the solar water heater, in fact it do not consume electricity at all when compared to other mode of water heaters.

You can ask the society to give it in writing the reasons for rejecting your application.

You can resort to legal action against the society if it still arrogantly refuses you top instal the desired solar water heater.
