Sir, I am ex employee of one of the company xyz and resigned from company in feb 2017 due to my personal reason but company appoint as consultant and give half salary and allow to work from home. But sir i am not recieved salary for the month of feb 2017 and when i asked for salary they told me company in loss we will give you salary. Company not give salary for current month means Aug 2017 .that why i am send one mail and put all details that i am not interested in your wotk because you will not paid salary for month of aug as well as feb and i am also writer i have not attend any call and email from your end. Some issue is coming and company is not able to solve they ask me to solve but i am not interetesd to solve their issue because they will not give salary and they want i will do thier work on free basis without slaary. Company will file complaint against me in police they told the police i am delete their data and not giving backup. but therir is no policy to take backup more than 1 day other third party vendor restore wrong backup and they blame myself. Sir advise me what i can do ??

you can in your defence take the plea that there is no company policy of taking backup data
2) you refused to work for company as they failed to pay your salary
3) if third party vendor restore wrong back up you cannot be blamed
4) deny all allegations made by company
You will have to negate all the allegations that have been leveled upon you. You can not be blamed for the act of third party moreover for the act of vendor who restored wrong data.

The company cannot lodge any complaint in this regard if there is no agreement in this regard and also you are not bound to oblige them anymore as the remuneration
for the work has not been paid.
Yo can challenge their claim properly wen the matter is coming up for trial if at all there is a case filed against you.
1. Serve a lawyer's notice to the company to release your salary.
2. If despite the legal notice the salary is not released then a civil suit for recovery of money with interest is the only legal remedy.
