• Visa for my pakistani national partner living in the uk

We have been living in the UK for last 7 years
My name is Prabhjeet Walia(Indian National).I am currently living in the UK with my partner who is a Pakistani National her name is Anum Younas We are trying to get our stay together in the UK but if we are not able to get this sorted What options we have so that we can live together.
1. Can she apply for some Visa from UK FOR India and what are the visas she can apply for because she has no one in Pakistan and there is a danger to her life if she goes to Pakistan so i have to apply for her Visa from UK.
But if she has to go back to Pakistan what are her Visa options to India.
And what will be the procedure for her to stay in India with me.
Is there any Government support we can apply for.

1. Getting visa and the entry into any country dedns on the wish of that country and now alw can force a person to have entry into that country if she is not the national of that country.

2. UK is still liberal with pakistani nationala nd your best option lies there though there is no harm to apply for her visa for India also.

3.if Visa is allowed and her entry is permitted then she can stay in India as long as the visa period is not expired which cna though be extended at the discretion of Union of India.

4. there is no government support for this.

2). A visit visa can only be granted to a Pakistani national who does not have a resident or occupation in India and whose sole objective of visiting India is recreation, sightseeing, casual visit to meet friends and relatives etc. No other activity is permissible on a visit visa. A visit may be issued normally six months with multiple entries and is non extendible and non convertible. The duration of the visa is the sole discretion of the Authority.

3) if you marry the pakistani national then she can apply to convert the tourist visa to X visa

- If you intend to get married to her, she may apply for a tourist visa for India in the Pakistani Embassy at Uk.

- Once she enters India and you both get married, convert her tourist visa into an Entry visa.

If you both marry in UK itself and then enter into India, in that case, she can directly apply for Entry Visa.

1. What is the danger to her life in Pakistan? Pakistan is an enemy country, so it would be very difficult for her in the first place to obtain an Indian visa. 99.99% of visa applications made by Pakistani citizens are rejected in a summary manner on a daily basis. Her application too will most likely meet the same fate.

2. India had started visa on arrival for Pakistani nationals through Attari border in Punjab but this was made applicable to only those Pakistani citizens who are aged more than 65 years.

3. If she were though married to a citizen of India or had a relative in India then her visa application would have good prospects. However, threat to her life in Pakistan is no ground to grant her Indian visa. Be that as it may, nothing stops her from applying for Indian visa.

She can visit India on temporary visa i.e., visit or tourist visa but she may have to comply with lot of formalities in this regard.

If you intend to marry her then you can first bring her to India on tourist visa, which will be granted for three months after which you can get it extended for another three months after that you can apply for spousal visa by filling up details in the form kept at FRRO office.

The High Commission of India follows a streamlined process while considering visa requests from Pakistani passport holders.

Visa services for Pakistani nationals are governed by the new India-Pakistan Bilateral Visa Agreement, 2012, which came into effect on December 14, 2012.

Visa issued to Pakistan nationals are city specific and ordinarily a visa is endorsed only for travel to 5 (five) places during each visit.

All Pakistani nationals, except those holding Indian visas endorsed “exempted from police reporting”, will be required to register, in person, at the nearest police station / Foreigners Registration Officer (FRO) / Foreigners Regional Registration Officer (FRRO) within 24 hours of reaching the specified place of stay.

You will also have to make a similar report 24 hours prior to your intended time/ date of departure from each place of stay to the nearest police station / Foreigners Registration Officer (FRO) / Foreigners Regional Registration Officer (FRRO).

what are options from UK

Fill out India tourist visa application form online;

and send the following documents to VisaHQ:

A

Indian visa application form. Completed application form for India will be prepared within 5 business hours of order submission, and emailed to you to download, print and sign.

B

Original, signed passport with at least 6 months of remaining validity.

C

Photographs: 2. Photographs for an Indian Visa Application must be 50mmx50mm ('2x2') and taken by a professional photographer.

D

Proof of Status. Proof that the applicant has had resident status in the UK for more than two years. If this is not the case or proof cannot be supplied a supplementary form is required, the processing can take up to 15 days and an additional fee of £11.05 will apply.

To prove residency in the UK for more than two years, applicants need to provide:

- Stamp of Indefinite stay issued over two years ago OR

- Utility bills pertaining to the current month and one dated at least two years back, but not older than 30 months.

Acceptable utility bills are: land line telephone, gas, electric, water, council tax bills. Bank statements and "mix and match" utility bills are not acceptable.

E

Multiple Entry Letter and Itineray. If multiple entry visa valid more than 6 months is required, you must include a letter explaining precisely why a multiple entry visa is necessary. The decision to grant or deny the Multiple entry visa to India lays entirely with the India Embassy.

F

Bank Statement. Copies of original bank statements from the past 3 months (no online statements accepted).

G

Employment Letter. Copy of a letter from your employer on business letterhead, with contact details, stating that a leave of absence has been granted, purpose and duration of the trip, and that you will be returning to your current job. The Employment letter must be addressed to the High Commission of India. If you are self-employed, include a copy of your business license and tax return. If you are retired please submit proof of your retirement fund.
