• Name correction in birth certificate

My daughter's name is registered as XXXX Saha in her birth certificate. With this she was admitted in school. Before Class X exam her surname has been changed to Sensaha to include her mother's surname "Sen" i.e to include my wife's surname in our daughter's name by an affidavit and her Class ten certificate shows changed Name i.e XXXX Sensaha. Now I want to correct birth certificate of my daughter to XXXX Sensaha. My daughter birth place is West Bengal. Now please help me : How can I change her name in Birth certificate?

You can go to municipal office with the affidavit, news paper publication and tenth result. The same will be changed easily then.

1. The name in birth certificate shows that name and status of the child as it existed on the date on which the birth was applied to be registered. A subsequent change in the name does not entitle the holder of birth certificate to change his name in the birth certificate. Only a rectification can be made in the birth certificate. In some states such as Rajasthan one opportunity is given to a person to change his name in the birth certificate, but this has not been replicated in all states.

2. So if you wish to incorporate your daughter's new surname in her birth certificate then you would require orders to this effect from the civil court.

No, this is not a rectification. This is also not a change of name as your daughter is not changing her first name. You only want your wife's surname to be suffixed after her surname, which cannot be allowed.

Minor corrections in the spelling of the name can be permitted to be corrected especially if the name was spelt out correctly in the application and has been erroneously spelt in the birth certificate.

The name once registered in the birth register cannot be changed due to an after thought change in name by parents at a later stage.

You can better go for change of name by procedure of law i.e., by getting it published in the government gazette publication after observing necessary formalities in this regard.

a) We want to rectify my daughter's name just by adding my wife's surname so that my daughter's surname will be combination of my wife 'Sen' and my 'Saha' i.e. 'Sensaha'. Is it not possible to get rectified birth certificate?

It is actually not rectification but it is called as change of name.

b) It the rectification is not possible then what I have to do so that there will be no problem in future.

You have to follow the change of name procedure for getting the name changed through gazette publication, you cannot get the name corrected or changed in the birth register at this stage.

Yes the birth certificate can be rectified, you will have to get an affidavit done alongwith a newspaper publication. The authorities will issue you a new birth certificate with new name.
