• Fake court case

One of my friend has approached the court against me through an advocate by attributing that I have developed a special software and with the help of this software I hacked the mobile number of his and his family members and used to abuse them using the same software. 

Here it is to intimate that earlier the same person has defamed my family through placing the photographs of my family on facebook with unwanted comments. The same was reported to my department(CISF) on preliminary enquiry he was awarded with suitable punishments.

Now he is regularly approaching the court and police station for disturbing my peaceful life. I have never done such type of thing.

recently police has come to me enquire about the case. I have submitted my consent to police and they had intimated that no proof existed against me,

Please give me a suggestion that i should do. what will be the outcome of the case and is the case civil or criminal. Should i appear in the court , what happens if a notice is been received by CISF from court.

You can file an FIR against him and can also file a petition in Higher court for challenging the prooceeding since they have been filed to take revenge, and if you are not going to the Higher Court then you will have to appear before the lower court otherwise BW followed by NBW will be issued.

1) file complaint of criminal defamation against person for having maligned your reputation

2) you can also file suit for damages

3) if criminal complaint filed by your friend is false

police would file closure report

4)you should appear in court if notice is issued to you and contest the case

The offence is related to cyber cell .. The police is Conducting its investigation.. U don't have to worry since no FIR is registerd... In case of FIR apply for anticipatory bail..
