• Land Aquisition

Government has acquired 0.77 acres out of 2.11 acres of my land in the year 1998 for irrigation canal extension and gave compensation according to the market value at that time.
After 2 years we have made that land flat by paying money from our pocket and growing crops for our livelihood .
The land has not been removed from online and we are paying tax to that land since 19 years.Others whose land also acquired at that time along with us has removed from online.
Recently in the month of August, They have removed it without any notice and occupied it.
Because of this we have problem of using the water from canal.
Is there any chance of getting the land back as we have paid tax since 19 years ??

Your 0.77 acres of land has been acquired by the government and compensation has been duly paid to you

2) merely because you are paying property tax does not confer title to property

3) you would not get back the land as you accepted compensation for land acquired by govt

No chances are bleak but you can claim the amount of tax you have paid for the land that was not yours.

1. You have already accepted the compensation paid to you, so you have no case for getting the land back.

2. However, you can file a civil suit against the government to recover the tax paid by you due to the fact that it has not been removed from the records by the govt.

If the possession the acquired land stayed with you till 1st of Jan 2014, the 1988 acquisition will be deemed bad. In terms of the new land acquisition act, sec. 24(2) where either compensation land was not paid or the physical possession of the acquired land was not taken until 1.01.2014, the old acquisition will lapse and the government will have to release the land.
