• One of the GPA holder's name is missing in the sale deed

Hi,
Person A sold his land to person B through GPA. Person B sold to Person C through GPA. Person C later registered the property in his name and executed a sale deed also. But in the sale deed Person B name is missing.Now person C is facing issue while selling the property as the name of person B is missing in sale deed. Please help me is there any way to rectify this.

What kind of problem is there,, when you have s clear title in your name.. There should be no issue in selling further

Yes, there's a way out . Ask C to get done a tittimma (rectification). After executing a rectification deed, he will not face any difficulty in selling off this property.

deed of rectification cannot be made by owner C without presence of party B , as in sale deed executed by B in favour of C the name of B is missing

2)contact a detective agency to trace B

3) courts fees would be nominal . legal fees vary depending upon lawyer engaged by you

Yes, the presence of A and B is not necessary for executing the rectification deed. The costs etc. involved would be told to you by a local Lawyer.

Cost will depend on the lawyer engaged by you, yes the rectification can be made in his absence also, you will have to give an application in this regard to the sub-registrar and if the sub-registrar is satisfied by the reason given by you then he will allow for the same.

Person C can get a rectification deed executed and registered through the same GPA by adding the name of the B, if the GPA is not available then B can be approached for executing a registered rectification deed rectifying this error.

To make the rectification deed do all the previous owners i.e owner A and owner B are required as witnesses?? we are not aware where the owner A and owner B are residing now and we have no way to contact them. So is it possible to make rectification deed by owner C without the presence of owner A and owner B.

Also what would be the cost of making this rectification deed?

Since the name of B, who was the owner of the property at the time execution of registered sale deed in favor of C through a GPA was reportedly omitted to be mentioned, the same alone can be rectified through the same GPA. The A or B do not have to put as witness in the ratification deed.
