Hi guys I purchased santro xing pb number from an agent 1 and half year ago. I was about to gain possession of my flat in punjab and registration would have been breeze. but now the possession has been delayed and i want to register vehicle on my name for that i require noc from owner. i am unable to track the owner and the agent is not also cooperating please suggest an alternative. i do have rent agreement of my flat in mohali punjab. i also work in an organisation in punjab and have few friends who have flats in punjab registered on there name.

For registration of vehicle in your name NOC from seller is must
2) RTO Form Number 29, 30 are considered Sale Transfer Forms. This needs to be signed by both seller and buyer
3) further seller has to inform RTO of sale of car
4) in your case if seller is not cooperating sue the seller to recover your money
The point is I am unable to track the owner and the dealer is not cooperating as well. I have been running this vehicle without trouble for lat 1 year. I don't think that the seller have informed the RTO. The vehicles here in Punjab are sold through network of dealers or sub dealers. They take signature of owner on required forms and pass it on till the vehicle gets sold. I assume that my dealer doesn't have the contact information or the original owner and I am not aware if he(owner) will be available on the address mentioned on the RC. I just need to Know if I am able to migrate vehicle on my name using Rent agreement(Its from same state punjab) or is presence of Owner necessary to apply for NOC(In case I rent agreement doesn't work and I need to get it registered in Himachal pradesh). I do have other documents signed by the owner except NOC with me. Thank you for all your valuable guidance so far.
You need the sale transfer form signed by owner to transfer vehicle in your name
You would not be able to register vehicle in your name if you don't have the transfer forms filled in by the seller

You will have to see whether the RTO Punjab accepts Rent agreement as valid document.
If the dealer has signature of seller on all the reuired documents then there is no need of physical presence of the seller.
NOC can be obtained without his presence.
If Rent Agreement is not accepted then you will have to get it registered in HP.

When you knew tht the vehicle could not be registered on your name without proper proof then how did buy the vehicle.
Do you have transfer order (TO) from the seller?
Do have the receipt for acknowledging the payment received towards the sale of this vehicle?
If the agent is not cooperating then you may either issue him a legal notice or can lodge a criminal complaint against him for cheating you by giving fake document hence not cooperating for the transfer of registration of the vehicle in your favor.
If the NOC alone is the problem for getting the vehicle transferred to your name you can make an indemnity bond and attache along with other documents seeking transfer of the vehicle indemnifying the issue, if the RTO officials do not encourage or accept the indemnity bond then you may have to revert to the situation of obtaining NOC from the owner thorough the agent
