Sir...My father died in 1997 and mother also died in 2012, leaving properties 5 children behind. I am the only daughter with 4 brothers. I got married in 1980. After death of my father, in 2002, my brothers managed to enter their 4 names in the properties omitting my mothers and my name, without my consent and knowledge. Now my 4 brothers denied my share saying that they were the only 4 partners of the registered firm of which my father was the sole owner. After that they additionally entered their children names and denied my share. I am helpless now. Kindly advise me whether I should proceed legally. Thank you Sir.

1. if this is your father's self acquired property then you can claim your share.
2. all the children irrespective of son or daughter have interest in father's self acquired property.
3. there is only restriction i.e. they cannot claim share in the life time of father.
You can file a partition suit and seek your legitimate share and its separate possession.
