My father sold 3acre land in 2006 Feb.i we have 2 brothers majored.I signed at time of sold but my brother at abroad.we distributed land between us.the sold land on me expediture of study.till now I asked revenue why is my land on coming 1b&pahani.why didn't remove from records.gramapanchayay constructed colony.wat should I do give details

1) is it self acquired or ancestral property of your father

2) if your father has sold his self acquired property your brother consent was not required

3) you must have signed as witness

4) you r father has shared sale proceeds with you and spent money on your studies

5) i presume sale was by registered sale deed

how was sale done?

if sale deed was not registered purchaser does not have clear and marketable title on land

mutation of property in revenue records is only for payment of property taxes and does not confer any title

1. Your query is not comprehensible to me. If the land that has been sold by your father was his self acquired then there can be challenge to it. UNless you had a share in the land as on the date of sale you do not have the locus to assail it in the civil court.

2. It is not clear on what basis do you call the property ancestral. Consult a lawyer with all documents of property to get a clear opinion.

Self own property can be sell the person as per his wish in any time. There is no need for putting the signature of his son or others.Also know about what is ancestral property.

Ancestral property is defined as the property whose title has not changed for last 4 generations i.e. from great grandfather to great grandson without being interrupted by any partition/settlement/sale/gift deed or will. If it is not so, then it is not an ancestral property.

File application under RTI Act before the Village office and Registration office with regard to title ,extent ,possession of property which is kept in your fathers name .If you got the papers you can move forward easy.

if assigned land was ancestral your father needed your brother consent to sell the land

2)you have not mentioned whether sale of land was by registered sale deed or not

3)your father has to file declaratory suit that he is absolute owner of the land if he did not sell land by registered sale deed

4) seek to set aside mutation of land if done in favour of buyer

5) contact a local lawyer as the various documents cited by you have to be perused to advice

What you wanted to clarify by posting this unclear question is not understood.

if my guess is right, then you may have to approach the revenue authorities for relief and remedy.

If your name has not been removed from the land then the purchaser only has to worry about it, has he taken any action on it?

If you have title document to the property in your possession then you may have to apply for transfer of revenue records on your name with the revenue department.

You have to make representation before the Tahsildar for cancelling the records now transferred on somebody's name without your consent of permission.

If there is no proper response then you may aproach court for relief and remedy.
