• Name transfer of our property

We have a Property in the Name of my Mother, my Father had expired, I have one elder sister who got married and settled, Now I am Planning to build a house in that property by applying a Housing Loan.
To that I need to transfer the Name of the property to myself. What is the procedure. Your Valuable advise will help me.

Hello,

If hou are planning to take a loan against that property then you will have to get the same transferred in your name which can be done through a sale deed If the property is the self acquired property by your father.

And if you just want to start the construction on that property then you can start the same, this will not make any difference as to who holds the title of the property.

And if you anticipate that your sister might fight for the property in future it is better to get a will registered.

1)your mother can execute gift deed to transfer property in your name

2) gift deed should be attested by 2 witnesses

If the property is registered in favour of your mother then she is at liberty to transfer it to you through a gift deed. The consent of your sister is not required.The gift deed has to be mandatorily registered.

The property in the name of your mother need to be transferred to your name by a registered deed, and this may be either settlement deed or by a sale deed or a gift deed.

You can be eligible for property/housing loan only when the property is in your name.
