• Vakalatnama signed by me without my knowledge

My husband .... Without my knowledge. Took sign on vakalatnama which was blank.....And gave me false reason ...I m doubt full that he took it for divorce ...If in future there r disputes....What shall i do .....I do not want to divorce him...Pls guide

1) you should not sign any blank document

2)send an email to your husband not to use the blank vakaltnama for any purpose

3) mention that name of lawyer was not mentioned and that you have not authorised lawyer to appear on your behalf in any legal proceedings

4) in the event your husband uses said vakaltnama for divorce case issue notice to your lawyer that you do not want him to appear on your behalf and to furnish his NOC to enable you to engage another lawyer

5) appear in court and seek permission to engage another lawyer

1.Mere signature of vakaltnama would not cause final harm.

2. Though he can engage a lawyer of his choice on the basis of vakaltnama but to file any case or consent to be recorded your signature is required.

3. Engage a local lawyer and ask him to search the court filing register fromtime to time. if he fiels any case it will be recorded there.

Hi, Even though he has taken the signature on the vakalath, nothing will happen. Because in divorce case you have to be present before the court and without your consent the court will not grant divorce.

vakalatnama signed alone will not be enough to get the divorce.

you should stop your husband from misusing it , send him notice/ email or letter asking him to not to use the vakalatnama signed as it was a blank.

ask him about the lawyer's name, and contact the lawyer.

Get the help of any other lawyer and check whether any legal proceedings are initiated which can affect your interest /divorce , if so take necessary action.

3) even if he misuses vakalatnama email sent by you would help you in with drawing your consent and engage another lawyer

If he files a case for divorce, you will certainly come to know about it which you can challenge it then.

You can express before court that the signature of vakalatnama was obtained by force.

Mostly this may be for mutual consent divorce, hence the court would summon you to be present before court without which the case cannot proceed, hence you can be rest assured.
